The tragic death of severely unwell Mark Wood, who died of malnutrition just five months after he was found ‘fit for work’ by Atos and the DWP, was not just ‘wrong’ as the Government have today admitted – it was grossly negligent. Whether this negligence was criminal must be urgently investigated.
Morally, and almost certainly legally, the DWP have a duty of care when making decisions which can potentially devastate the lives of those called ‘vulnerable adults’ by care professionals. The Work Capability Assessment, which led to the death of Mark Wood, has already been found unfair for people with mental health conditions in the courts. Instead of halting the assessments based on this judgement, Iain Duncan Smith has brushed it aside – convinced he knows better than the courts, the medical establishment and the thousands of sick and disabled people themselves driven to despair by the current system.
Mark Wood’s death is far from the first linked to welfare reforms. A recent report by the Mental Welfare Commission for Scotland (PDF) highlighted another suicide which they found was directly linked to the Work Capability Assessment (WCA). In a damning report, the charity surveyed 56 psychiatrists who had treated patients facing one of these crude, computer based assessments. Their findings are both horrifying and desperately sad:
“85% of the 52 respondents to this question told us about an increased frequency of appointments. 65% had at least one patient who required an increased dose of medication and 35% reported at least one patient who had changed medication. 40% had at least one patient who had self-harmed after the WCA. 13% of respondents reported that a patient had attempted suicide and 4% (two RMOs) stated that a patient had taken his/her own life. 35% said that at least one of their patients had been admitted to hospital as a consequence of the WCA and 4% told us about a patient being detained under the Mental Health (Care and Treatment) (Scotland) Act 2003.”
The Work Capability Assessment must be brought to an immediate halt. Even the company in charge, the notorious Atos, finally seem to have realised this, confirming this week they will pull out of the contract early. This is the only way to stop any more deaths, and it needs to happen now, as in this week. Otherwise more people will die.
It is no longer enough however to call just for the Government to scrap every aspect of the bungled and brutal welfare reforms that are destroying so many lives. People are dying in one of the richest countries in the world as a direct result of this horrifying attack on the very poorest people. The politicians in charge know this, but are happy to let these deaths continue as part of the ideologically driven obsession with proving that people on benefits are scroungers or fakes and that unemployment is caused by unemployed people.
According to the Daily Mail, David Cameron has backed an urgent review into the Work Capability Assessment. This review should not just look into the failures in the process but assess whether negligence has taken place and if so who is culpable and whether criminal charges can be brought. If Iain Duncan Smith. Atos or the DWP, can be put on trial over these shameful deaths it will not bring anyone back. But at the very least it will send a message to every politician, today and long into the future, that the UK’s legal system will not tolerate reckless cost-cutting experiments that put human lives at risk.

Just received a letter from one of the DWP’s little Hitler’s, the disability denial section officer, (no names – jv) of Bradford…..
After submitting more evidence for my upcoming ESA tribunal,in which i gave them one of their own doctors reports that stated i was “incapable of all work”.
Strangely, replied;
“It is entirely possible that a claimant may be passed unfit for work under the Personal Capability Assessment but be found capable of work under Work Capability Assessment”
This is complete gobbledygook, having one purpose only, to steal your disability benefits……………….
In my further medical submissions to the ESA tribunal, i asked what medical qualifications the DWP DECISION MAKER had.
replied;
“I submit that in selecting descriptors for the physical and mental activities the decision maker has considered all the available evidence but preferred the recommendations of the Health Care Professional since it is a functional assessment made by a qualified medical practitioner who is experienced in carrying out assessments and who is independent of the decision making authorities and is disinterested in the outcome of the claim”
This reply speaks for itself, THE DECISION MAKERS AT DWP HAVE NO MEDICAL QUALIFICATIONS WHATSOEVER!!!
……………at the end of my letter, it states;
“The healthcare professional acknowledged that he suffers from back problems, rheumatoid arthritis,a hearing problem and a bladder problem”
I submit that the decision maker considered all the available evidence when making their decision and in doing so agreed with the Health care professional’s recommendations and did not award any points………….”

I noticed the BBC stopped broadcasting its loathsome ‘Saints and Scroungers’ series about the same time Atos announced it was going to try and get out of its DWP contract early.

Julia three weeks ago I had to drive ex to one of these difficult to park hospital jobs. Whilst waiting on one of these trading estates a guy in a track suit dropped his trousers and peed. It was clear from his body movements he was probably mentally handicapped/mentally ill. And also a product of Thatchers NO CARE IN THE COMMUNITY. In the establishment I use to work in he would have been sanctioned for that behaviour. Instead he’s wandering the streets aimlessly defficating as he pleases.
The biopsychosocial approach to medical conditions, which is the whole basis of the ESA regime, now needs to be properly scrutinised. Some good researchers need to take a good hard look at the datasets and methodology of the medical works the DWP uses to justify its “fit for work” iatrogenic quackology. Waddell, Burton, Aylward Mansell, Dame Carol Black and the Wessely school of psychiatry, amongst others, all inflict their baseless pseudoscience on disabled people without the slightest regard of recording or registering harms to patients.
Hence the reason biopsychosocial codswallop is so popular with private insurance companies and government departments such as the Dept of Health, the Ministry of Defence and the DWP. War pensions can be stolen from the likes of Gulf War Illness veterans, and payouts denied those with private health insurance, as well as welfare benefits denied those applying to the DWP for help. And there is no way to report iatrogenic effects of biopsychosocial quackology which is used to abuse the sick and disabled in this way. It’s win-win for those in power and hell for disabled people and sick patients.

If there is one thing to learn from the evidence of the WCA circus, it is the sheer abusive and cruel humbug of trying to cobble a loophole to ‘prove’ that an individual who has been signed off by his/her own doctors might still, somehow be fit to perform ‘work’. (Where ‘work’ is redifined, according to a fly-on-the-wall investigation of Atos, as a paraplegic being forced to mindlessly press a button for hours on end with his one functioning finger.)
And forced workfare for the disabled attempting to claim through our National Insurance system, is like, if someone burgled your home, but then your insurance company could sentence YOU to unlimited months of forced labour in ‘community payback’. (At least when UNUM Insurance wrongly blocked claims and acted as a ‘disability denial factory’ in the US, it didn’t herd many of its customers into a chain gang clearing out parks, as our DWP is currently doing.)
When someone has a serious illness or injury from which there is any hope of recovery, they invariably need rest to do so. Tiring or stressing them out will invariably mean recovery takes longer or be incomplete, with an increased likelihood of future complications and exacerbations. Archaeology tells us that even the NEANDERTHALS knew this, with evidence of the elderly, weak or injured being nursed and looked after until they either recovered or died. However the BPS Model denies a knowledge as old as the human race to accusingly insist that ‘there is no such thing as illness’, and that the ‘illness behaviour’ arising from, say, cancer or a broken back, is a form of moral deviancy arising from laziness and scrounging.
Certainly, many sick and disabled individuals can still work, but generally it is those who are generally healthy but with an impairment (like most of the paralympians), or a chronically sick individual who is in the EARLIER stages of their condition, and not yet housebound or bedridden. There again, there are unique individuals such as Stephen Hawking. Anyone know the cumulative cost over the decades for the ‘reasonable adaptations’ in terms of cutting-edge equipment and nursing entourage? While easy to justify for a world class scientist, would Poundland be happy to provide such support for Atos’ iconic paraplegic able to move just one finger to press a panic button?
Underlying all this is a ‘mass surveillance model which assumes that ALL British citizens are potential criminals needing to be watched and monitored every moment of the day and night, lest we shirk or scrounge. Matters IN the workplace are bad enough with incessant monitoring of everything from keystrokes to toilet breaks and increasing gov’t pressure to deny short-term sick leave.
The point of the WCA is ONLY to overturn the doctor’s reccommendations that individuals rest and recover at home. It does not attempt to identify fraud (where, if it existed, the doctors who diagnosed the disease would be accomplices). And since few employers would risk taking on a worker who might be facing regular periods of severe incapacity and hospitalisation, the WCA then conscripts these people back to JSA (hacking into their benefits) or WRAG, as a means of herding them into forced labour (which will shorten their lives and save the DWP their benefit and pension money).
The idea of forced work for the disabled must end, together with the cruel inquisitions leading to this sentencing.
For that matter, CAPITA is the company that has harrassed the vulnerable over BBC TV licences for many years, and googling the cruelties and abuses of that system makes for enlightening and horrifying reading. (Incidentally and Atos ‘inspector’ entering your home to test you for PIP, WILL be checking for any equipment that could recieve broadcast TV, and should they spot any evidence for the use of, say, cannabis, on your premesis, they WILL be tipping off the police as company policy – because all this has happened over recent years to BBC refuseniks).

On March 4, 2014 I wrote to Mike Penning, formally requesting that Mark Wood’s Atos and DWP files, along with the coroner’s report, be sent to Jorge Araya, UNCRPD Secretary, pursuant to a possible UN inquiry into his death.
“I am willing to give your Department sufficient time to collect and send a copy of these documents (including written permission from Mr. Wood’s family, if necessary) to the UN’s Mr. Jorge Araya—but kindly ask that you acknowledge my request within 20 working days, to both myself and Mr. Araya, expressing your compliance.”

The EU ought to do something but they are only interested in money, like this government. The UN should keep rattling the government so that they know for certain that this country is going backwards, and, the rest of the world should know just how the UK government despises the disabled and long term sick and continually hounds them. Good post Johnny. An inquiry should be held and people should be held accountable for the things this Government are doing but it wont be. As for the government holding an inquiry into the work capability assessment, they are merely paying lip service. Nothing will be done, and why should it? It doesn’t affect them. Like the way they brushed off any criticisms of Universal Job match this government are hardly going to find their own policies to be at fault.
True, but this is where Labour should be stepping in and promising that they will axe the WCA test and pay the full ESA amount to any person whose doctors have signed them off as unfit for work.
And that this benefit would be payable for as long as that individual remained sick (no more contributions-related WRAG, where people are left penniless after a year, even when they are still disabled).
Labour needs to reintroduce compassion to British politics, and become the party of common decency, as well as doing something to restore its credibility as the party for the ‘common people’.

btw, record numbers of people are now being evicted here in Yorkshire due to not being able to afford the bedroom tax, I have just received my council tax for the year and it has increased 38% on last year, so my 1% jsa rlse will not even touch it!

It’s been crystal clear for a long time that there really is a class war being waged, and the destruction of millions of lives is not simply “a price worth paying” for the Tories, but a central objective. Why? It’s a simple enough question, but no-one can provide an answer, beyond conjecture and the obvious.

In response to your questions there is a requirement for each Healthcare Professional
(HCP) to be approved to conduct medical assessments; this role is undertaken by the DWP
Chief Medical Adviser (CMA) who is also a qualified Doctor who is registered with the
General Medical Council.
The CMA approves the HCPs employed by Atos Healthcare to carry out medical
assessments, and separate approval is required for each benefit area in which the HCP is
involved. Approval is dependent on strict recruitment criteria being satisfied, successful
completion of all stages of their training process, as well as evidence of the HCPs
satisfactory performance within the training course and ongoing demonstration that the
HCPs work meets a satisfactory standard.

There are some truly horrific statistics in this piece showing conclusively that the strain of the assessments administered by Atos is immensely harmful – sometimes to the point of causing suicide and self-harm. Private Eye pointed out a few years ago in connection with the case of one young woman, who tried to end her life after being assessed by Atos, that such assessments are explicitly forbidden by law where there is a danger that this will make a person’s mental health worse. The government and Atos clearly are either ignorant of this, or simply don’t care. I’m not a lawyer, but I think in this case there is a very good case for bringing charges of corporate negligence, perhaps even manslaughter, against the company.
I am extremely pessimistic, however, about how much good the inquiry will do. We’ve seen previous inquiries into the DWP by the Work and Pensions Committee take a very soft line with IDS. Mike over at Vox Political has expressed concern at the way the Commission has not taken on his partner’s account of her problems with the DWP as evidence, but will only circulate it as ‘background information’. This inquiry looks like it’s going to be another whitewash by the government, a token gesture to make it look like the government is concerned and doing something, when it actual fact it has no intention of making any more than cosmetic changes to the system. I hope I’m wrong, and look forward to the day when charges will be brought against Atos and IDS and some of the others responsible for this murderous policy.
The system cannot do an enquiry into itself. It’s simply ludicrous. It needs to be a totally independent body with power to make the government act on it’s recommendations. That will never happen. Remember how IDS changed the law overnight regarding illegal workfare? Well when you’re above the law no one can touch you.
This has to go down the UN or EU route as regards a crime against humanity or a violation of basic human rights and be investigated by the UN or EU as such. What powers they may have over the UK i don’t know but as much pressure as possible needs to be put on them regarding this.
Let’s see, hounding people and illegally withdrawing their benefits leading to said persons death, i’d say that’s a crime against humanity when it’s done on a scale where thousands are affected. Politicians have a free pass to do what the heck they like called “collective responsibility”. Thus responsibility for any suffering, pain or death that results is spread across hundreds of democratically elected individuals which prevents any one person from being blamed for anything that goes wrong. The basic income incentivising work principle is no different from the making work pay slogan of IDS. A basic income would always be at or below subsistence levels for the poor and unemployed. Based on we are all in this together universality rather than need it could turn out to be the biggest poverty trap ever created.

Basic Income is the principle behind Universal Credit – making work pay – or as the BI lobby say incentivising work, the pressure on that basic income would be downwards or stagnation like the minimum wage.
Both BI and UC appear to share the same imperative keeping the unemployed on or below subsistence level in the uncertain objective of full employment.

You are wrong regarding the job situation, yes jobs are being lost for working class people but are being created for administrators, local law enforcers, baliffs etc, all of the jobs nothing but overbearing jobsworths would want and they will be increased to keep the general public in line.

I’ve no idea who this Fink is and I’m usually a reasonable person but I am getting increasingly frustrated with this brick wall and confusion between Universal Income for all (as being pursued by more free-thinking and relatively Socialist-minded people in Europe) and Universal Credit aka Chaos as bastardised by IDS which is nothing of the sort. Perhaps you might think of doing a post on it as these people will listen to you but they’re not listening to me or OBD or anyone else who tried to explain it to them. I started off being polite but it’s just useless. Too many people have got stuck in the Protestant Work Ethic idea that in order to get the fundamentals of existence eg heat, warmth and food, you owe somebody something in the form of work. I don’t believe that. There’s not enough ‘work’ to go round. We don’t have to ‘pay’ for existence in terms of this narrow definition of ‘work’. Whether artist, carer, voluntary worker, old person, carer, disabled, layabout, we are all deserving of the basics of existence. It ain’t got anything to do with IDS. Economists like the legal profession are working mainly for the state, the state may convince those training in these disciplines who fight amongst themselves in the belief that their input can have any relevence to how economic decisions or judicial outcomes are arrived at, but we know it is the money men pulling the strings behind the puppets they have put in positions of power.
The banks are not lending not because of sub prime lending mistakes and all of the rest of the crap they have been feeding the electorate, they are either using banking capital investments to invest in manufacturing abroad where they can make huge profits, not by lending to industry here until they have reduced wages enough for the working class to make it worth their while to invest in industry and production and even then most of the work is done by apprentices when they start lending to business again.
The private sector has only increased jobs by stealing public money to fund the poverty pimps, increase the publics fear of crime and disorder to employ more so called crime fighters who believe they are doing their duty as a decent citizen to fine people for littering etc.
We have a week now of this crap being fed to us in the pipeline from channel 5.

Yet JCP are quite happy to share jobseekers’ personal data with Work Programme Providers. JCP staff can also direct jobseekers to create a profile and CV on Universal Jobmatch, a site run for the DWP by Monster.
The WPP’s are no different than the Joke Centre Minus when it comes to jobseeker’s personal information. Yet when they are requested to cease and desist by consent withdrawal letters, they blatantly ignore this.

Help to Work is supposed to start tomorrow on April 1. Let’s hope it’s an April Fool joke! I’m eligible and haven’t heard a word about it from the jobcentre yet.

I wondered that, he’s probably forgotten about that, although he did mention apprenticeships. Which just means sticking ‘apprenticeship’ on the front of everything and dropping the pay to £2.68 ph.

The DWP no longer sanction any JSA claimant if they fail to take up, apply for, or continue in zero-hour contract work. If offered no pay work, tell the cunts the law now is on your side.
Whatever we think of IDS we know he will end up in the house of lords one day getting a nice few quid for sleeping on a comfortable seat. It wouldn’t surprise me if it’s a labour government that makes him a lord in the distant future.

I got a call from dwp on thurs telling me I had failed my medical and was therefore fit for work…for the sake of my young daughter I managed to get to the jcp the next day to start signing on again…after enduring the ordeal during which I had a panic attack and was crying virtually throughout I returned home to a weekend of hell……the stress of it all brought on a major depressive episode resulting in a visit to my docs this morning where I was given 2 new lots of medication and told to up my existing tablets…..prior to this I had felt I was making slight progress but am now back to minus square 1….. so thanks a feckin bunch to the lot of them…..NOT

According to a report in today’s Daily Heil, Osborne is saying the Tories will be the party of job creation. He also added that Help to Work will force long-term unemployed people to do tasks to claim their dole from next month.

Yep. Osborne didn’t actually say that full employment meant paid employment for all. The workfare nation is here folks. The underclass will be transformed into the workfare class.

I’ll know this week which employer will be attending the jobs fair. My complaint has been sent by e-mail to head office. If they take no notice or ignore it, i will send copies to the JCP and the WPP office in person. I may even e-mail a copy to my local MP for good measure.

There is one way to stop Iain Duncan-smith and the DWP and the Jobcentre Plus and the job centre plus staff and the g4 security staff and that is to use your mobile phones and use the video on your phone to record everytime that you go to your local job centre plus and please make sure that you have a piece of paper that the DWP put on line saying that you can record in job centre plus and also make sure that you take plenty of copies, instead of the original and also that g4 security guards are not police officers they cannot put their hands on any jobseeker and if they do, the police will be called and they will be arrested for assault and you will press charges and you will make sure that they will lose their job and make sure you have the assault on video for evidence against you and than explain to the police, why you were filming for your own security and to make sure that you was not being tricked or coned or miss said anything or that you didn’t turn up for any appointment or interview at the job centre.
