French IT firm Atos saying they are planning to pull out of Work Capability Assessments, the shambolic and cruel tests designed to strip away benefits from sick and disabled people, is the most humiliating blow yet for Iain Duncan Smith’s bodged attempt at reforming social security.
In a stunning victory for campaigners, Atos say the Work Capability Assessment isn’t working, for them, claimants themselves and even the hapless DWP. The attempt at early withdrawal from the contract comes just days after protests were held outside Atos assessment centres in towns and cities across the UK.
The astounding announcement also sheds new light on The Guardian story which revealed that the DWP were secretly plotting to get rid of Atos and bring in new contractors to run the tests. There is truly no honour amongst these thieves as Atos and the DWP bicker in public about who dumped who first. Meanwhile poverty pimps like Capita and G4S will be salivating at the prospect of Iain Duncan Smith stuffing their mouths with gold to try and keep his bungled welfare reforms alive.
Atos has blamed abuse and death threats made towards their so-called ‘healthcare’ professionals as one reason they want to withdraw from the contract early. Yet Atos must have known that taking on a contract designed to impoverish sick and disabled claimants would lead to them becoming despised. It is no surprise that a very small number of people facing the WCA displayed what social workers call ‘challenging behaviour’. Any social care professional or even copper could have warned them about this. If Atos were unable to put in policies and procedures that kept their staff safe then they only have themselves to blame.
When people have been driven to suicide by the vile activities of this company, their whining about few scabby doctors being slagged off on twitter rings a little fucking hollow. The truth is that Atos have seen their brand made toxic all over the world by their involvement in these tests – which only represent a very small part of their business. This is almost certainly the real reason they have decided to embarrass the DWP by very publicly trying to abandon this contract.
This announcement does not represent the end of the WCA, but it could be the beginning of the end. Anything that at least slows the bastards down should be welcomed. This victory should be used as a springboard to escalate the campaign against whichever odious profiteers decide to take over the hated WCA.
If Atos think they are off the hook however they are sorely fucking mistaken. There has been no announcement from the company about their involvement (along with Capita) in assessments for Personal Independence Payments – the replacement for Disability Living Allowance designed to cut benefits from 20% of disabled people. These tests have barely begun and already are a shambles with claims taking months on end to administer. It will be those in and out of work alike who face these assessments which are little different from the WCA that Atos have just condemned. If the company think they’ve had problems with out of work sick and disabled people just wait and see what happens when they are assessing lawyers, other doctors, and even MPs.
Atos are also expected to be involved in George Osborne’s mass workfare scheme which begins in April. Claimants already found ‘fit for work’ by Atos could be abused by company again and forced to undertake 780 hours of unpaid ‘community work’ just for the crime of being unemployed.
Atos may be on the run, but they should be ruthlessly chased down until they pull out of all government contracts designed to bully, impoverish and harass sick, disabled or unemployed people. Until that day comes, Atos should remain firmly in the firing line.

Watching a grown disabled man, a good friend, pleading to have more than the £32 he is given, raised back to his former DLA that was stolen after a worthless ATOS medical.
Indeed, i left the tribunal with a feeling of mixed emotions, holding back tears as i saw first hand the evil that men do.
These people on tribunal benches ar far from being human, they are state picked disability assassins.
My friend explained that he and his partner and son had been reduced to eating cream crackers and cups of soup to survive, going on to tell in detail how they had not been able to light the gas fire for the last four years.
If the government says that a person needs £71 a week to live on, why force a disabled man and his family to live on less?
People like Judge J D Wall should be immediately struck off, compassion for another human being is not in their vocabulary!
I will never forget that awful day as long as i live. It will be firmly etched into my memory.
The DWP used to pick on me all the time until i mentioned that i had suicidal thoughts. Some things have changed slightly, some treat me like a human being, but others, mainly women, are ever so cruel.
The rising cost of diesel fuel and forced redundancy caused me to be unemployed.
Like my friend, we are neither shirkers or whatever else the government run media throw at us, we are trapped by unfortunate events in time.

As the tribunal drew to a close, the tribunal judge asked me if i had anything to say.

I have been married to my beautiful thai wife for over two and a half years,
She is not a bar girl, she is a nurse in a Bangkok hospital (no i haven’t had a dose, before you ask).
The wedding took place in my wifes village, the whole village turned out including the mayor, it was a really colourful event.
My wedding was registered both in the uk and Thailand, through the proper channels and embassy’s yet i have been kept from my bride.
I applied for her to come over to be with me but was informed that i would have to be employed and earning over eighteen and a half thousand per year.

I then asked if she could come and stay with me for a month and return to her hospital in Bangkok to continue working.
The government agency even blocked this application saying that because i had asked for her to come indefinitely on my first application, it was proof that she would not return after a visit…………

It occurs to me (and most of us) that this is a deliberate persecution by the State towards Geoff, your friend and a much admired contributor here.
It appears they are making an example of what will happen when the peasants don’t follow the ever changing rules and regulations.
It is clear from all that you have written about this Toddy, and what Geoff has said about the matter, the State accepts Geoff has problems that affect his ability to work. Though they have also deliberately falsified information to make it sound less difficult on for their paper files.
It is the Tribunal were not in the least interested in the disabilities or ill health or anything else.
This guy dared to question the system set in place, and that is not to be tolerated.
As it has been explained to us here, Geoff was awarded DLA for life. How can the State overturn this when it is clear his own doctors make say nothing has changed regards their client’s condition?
But that is part of the reason for creating the new PIP system.
The State can now, at its whim, overturn such Life Awards, and take ppl’s monies away completely.
It could be argued that all Geoff had to do was fill in the form and all would have been well..…
But far too many have made that very same mistake, and have found to their cost, it has not been “that simple” Nothing’s been well ever since. Besides, according to Geoff, he asked questions about the actual need for this form in his particular case, and not been given the answers.
We can only conclude that this appeal panel had its mind made up long ago.
There was no impartiality. There was no justice. Just as there was no Justice in the English Appeal Court on Friday regards Bedroom Tax.

I doubt that ATOS will pull out of the contract. The government are using ATOS to cover for far worse things they are doing to us themselves. ATOS are the perfect distraction. I’d be happier to see both the WCA and the PIP assessments ditched for good.
It’s extremely unlikely that ATOS give a flying fuck about the “death threats” to their staff as history tells me that a one time boss of ATOS, managed to achieve the highest rates of suicide (ever) amongst the workers of a large French telecoms company, during his period of office.
Note how they are making a big fuss about “death threats” and not the actual deaths of those whom these unemployable dregs of health care, actually assessed. It would have been more appropriate for ATOS to be withdrawing due to shame.
There would be huge penalty clauses on both sides to get out of such a massive contract. I don’t think either party would be keen on paying up. If there is to be an early termination of the ATOS WCA contract, then it’s likely to be a last ditch scramble to find anyone they can, even the dead, fit for work.
Contracts contrived in panic to allow the tories and ATOS to walk away from each other aren’t likely to be contrived to the benefit of the poor claimants are they?

My gadgets and models stop me from climbing the fucking walls in despair at the lack of any half-decent job. So the daily heil can fuck off if they think people like me are rolling in JSA each week and spending it like water.
As soon as I get my money in one hand, it’s all gone out of the next hand within minutes on rent.

Slightly off-topic with a mention of my model railway hobby, but the point I am trying to put across is, the government simply don’t want anybody to have some enjoyment out of life and don’t want us to have a bit of money unless in work and thus taxes being deducted from the wages to pay for the public toffs.
My gadgets and hobbies stop me from going up the wall in despair. The government don’t want people to enjoy life to the full if money is stripped away. They want us to work until we drop and pay their wages through taxation, not be allowed to spend a bit of money for our well-being, and be slaves.
All benefits are taxed, especially JSA. I should know this as every March/April I get a tax form detailing how much JSA has been taxed their previous 12-month period.
A spokesman insisted it would not ‘walk away’ from the contract and that it would continue to provide a service until new contractors had been appointed.
‘For several months now we have been endeavouring to agree an early exit from the work capability assessment contract,’ the spokesman said.
‘We will not walk away from a front-line service. Our focus remains on delivering the services we are contracted to provide in a professional and compassionate way until a new service begins.’
However, relations with the Department for Work and Pensions appear to be close to breakdown amid persistent criticism over the quality of Atos’s assessments.
Kate Green, shadow minister for disabled people, said: ‘People have been badly let down by Atos. But changing the contract isn’t enough. It’s time for the government to fundamentally reform work capability assessments so disabled people who can work are given support they need to find a job.’
The DWP yesterday refused to comment.

The DWP will always refuse to comment on anything that will put them in a bad light, either excessive use of sanctions, failing work programme figures, the ATOS scandal or IDS getting rebuked.
The DWP are a law unto themselves and really should be made fully accountable to every person in the UK. Every company in the UK, by law, have to release end of tax year accounts, unless I am mistaken. And if this is the case, the DWP should also show us in full detail net and gross figures of their expenditures.
If we were in full facts of how much money they are handed each year and how much is spent where needed or how much is wasted on vanity projects, the final figure would show total outgoings in wastage would be more than payments given to them to keep the corrupt thing going.
IDS is no more than a corrupt manager using petty cash to keep his company afloat by whatever means legit or not. Managers can be sacked if company accounts are being fiddled. Why hasn’t the bald berk been sacked for excessive wastage along with pure vanity and Daily Heil friendly bollocks?

Even better news (although I’ll believe it when I see it) is that Labour have said that they will also reform the whole ESA/WCA system, which is essential – getting rid of Atos would not have been enough, leaving the same absurdly inadequate descriptors in place. This overhaul by Labour won’t necessarily mean getting rid of work capability assessments, but hopefully it may mean fairer forms and assessments, hopefully by experienced and qualified assessors.

Dear Mr Cameron,
I am writing this letter to ask you when you are going to end your attack on the sick, disabled and unemployed. Your polices have driven the disabled to suicide and penury, allow me to elucidate:
I am fifty-five and in that time I have never involved myself in politics, e.g. I never got involved in the poll tax demonstrations and myriads of other things that put people’s backs up in my lifetime. I led my life quietly, daily caring for two-close disabled relatives and I did this with little money and no complaints, that was until your systematic attack on the disabled, which has made a disabled activist out of me and I was the most politically laid back person on earth.
As soon as you became prime minister you and your (complicit) ministers’ began the most vicious attack on the poor since the Tudor poor laws, which began initially with the help of the media (especially the Daily Mail) your skiver v striver rhetoric courted controversy and there wasn’t a day go by when skivers’ wasn’t demonised in the news and the likes of Osbourne and Iain Duncan Smith tried to use Mick Philpott as their ‘poster child’ for benefit claimants’.
Very few people (outside those effected by your cuts) complained: ATOS was exposed on BBCs Panorama and Channel 4’s Dispatches; even then it didn’t have much effect on non-disabled people – that was until you went too far! Since last summer, there wasn’t a week go by that the most sick and chronically physically and mentally disabled wasn’t found fit for work, cases like David Coupe that died whilst found fit for work when on appeal, I’m sure you remember when Dennis Skinner lambasted you in parliament last October? Even Richard III was found “fit” for work!
I could add hundreds of cases like David Coupe’s: cases like my son who is in a catch 22 situation, you won’t allow him to claim ESA and his autism prevents him from signing on, so all he has is his DLA to live off, until you take that off him with DLA to PIP assessments. It’s galling to think that you had a disabled son that you claimed DLA, how would you have liked to have been treated the same way that you treat others?
What angers me most is how you kept changing the law to suit your attack on the disabled, firstly, because there were so many successful appeals, you now have to await a mandatory reconsideration before you go to appeal and you have to starve whilst awaiting a decision, some have committed suicide and many have had to rely on food banks because they have no income. Even then the disabled – given no choice – STILL appealed and so you moved the goalposts further by considering charging for DWP appeals, how monstrous can you get? The situation has become that untenable that even the UN has criticised your bedroom tax policy. I am not a victim of the bedroom tax, but, I know that good people that are and it’s making their lives unbearable, especially as there’s NO smaller properties to move to. Is your hatred of the precariat that bad that you are prepared to see them out on the streets or in workhouses? A wise man once wrote: ‘Starvation makes the anarchist out of the meek’ I truly believe the demonstrations outside all the ATOS offices this week are testament to this and it’s just the beginning of the rebellion that’s to come and the acquisition of water cannons et al will not stop the festering anger, anger that will make the London riots like the queen’s tea party. I’m no prophet or anarchist; nevertheless, I don’t have to be either to foresee the outcome of your policies. Even ATOS are abandoning the sinking ship and want out of their contract with the DWP.
It’s not just the disabled that have been severely affected by the welfare “reforms”, I want to relate to you one experience of JSA sanctioning and please don’t tell me this is humane:
My friend’s daughter was sanctioned – the week her father died (January 2013) – for not looking for enough jobs! (n.b she was NOT workshy she’d been laid off from her job in hospitality – due to the recession)
3 months she was without money!!!!

The NHS as I write this a mentally ill woman is in a coma because she was denied ESA and mental health problems have rocketed.
SOCIAL SERVICES are inundated with cries of help off people that they wouldn’t ordinary see pre welfare “reform” days
THE POLICE the police and courts have been full of people whose crime was to steal when hungry, because you denied them benefits.
SCHOOLS: have to deal with absences due to sanctions of parents and trying to find places for children that have to move due to the bedroom tax.
COURTS: appeal courts are bursting at the seams with DWP appeals and debt collection for arrears from council tax and Bedroom tax.
I could write a thesis on the impact of your welfare “reforms”, but, what’s the point, you will not listen, just don’t say you weren’t warned when the impact on your welfare reforms go into meltdown.

This story was also on BBC News yesterday. They reported that Atos were pulling out due to death threats to their staff, illustrated with shots of protestors waving anti-Atos placards. They acknowledged that the company was controversial, and talked to people, who had been declared fit for work. They also reported that the DWP had called the company ‘unprofessional’ for going public about it.
Lucy, one of the commenters to this post, states that with the horrific employment record of their boss, Atos probably doesn’t care at all about the death threats made against their employees. This is probably right. Thierry Breton, the head of Atos, was brought in by the French government to run France Telecom when it was being privatised. Under his bullying regime, 35 employees committed suicide.
What was noticeable is that the BBC report did not mention the tens of thousands of people, who have died in despair and poverty after being thrown off their benefits due to Atos and the DWP. I was happy about this news but guess what I had in the post today, a letter inviting me to a atos assessment. My luck is rotten. Here I go again, having my pittance taken away. Sadly this time I have too much council tax debt and I think the bailiffs will have a field day as they are ready and waiting with nashing teeth at my door. Atos are reminding me of that nasty cop in ‘terminator’ they ain’t done with me yet. What the feck am I going to do now, with the not being allowed to appeal. This is the third time now in just 18 months. I am exhausted!!

ATOS are happy to give up their WCA contract because they have been struggling to fulfil their commitments to the PIP contract. Withdrawing from the WCA contract will allow them to devote all their time, resources and attention to carrying out the government promise of removing benefits from over half a million disabled people currently receiving DLA.
Its a pyrrhic victory… nothing more… nothing less.

Bungling Bedroom Tax villain Iain Duncan Smith has been accused of being “in denial” over his mishandling of the hated levy.
The attack on him came as the number of council tenants wrongly penalised in the scandal headed towards a shocking 40,000.
Results from 175 of Britain’s 346 local authorities now show that 19,140 homes had the cruel charge slapped on illegally.
That is already four times more than the 5,000 people whom the Work and Pensions Secretary had predicted would be hit by his failure to close a housing rules loophole.
The figures are revealed in freedom of information requests by Labour to councils – and it is likely the tally will more than DOUBLE once all the results are in.
The loophole means that social housing tenants in the same property since 1996 should not have had housing benefit cut.
They included tragic gran Stephanie Bottrill, 53, of Solihull, who killed herself – blaming the hated tax in her suicide note.
Shadow welfare minister Chris Bryant said: “Mr Duncan Smith is in total denial over the numbers hit by his loophole blunder.
“Despite Tory, Liberal and Labour councils across the UK contradicting him, he refuses to accept he was wrong.”
The DWP stubbornly stuck by its original figure.
A spokesman said: “We expect very few people to be affected.”
But Birmingham council alone says 2,100 of its tenants were illegally charged.
Glasgow has identified 913 cases, Lambeth in London 648, Warrington 452 and Cardiff 220. Those wrongly hit have been overcharged an average £640 each.
Mr Duncan Smith is looking at a £2.5million compensation bill before the loophole is closed next month.
The tax hits 660,000 social housing tenants, who pay £12 extra a week for one spare bedroom and £25 for two or more.
They include the “Angel of Woolwich” who tried to help soldier Lee Rigby after he was hacked to death on a London street last May.
Ingrid Loyau-Kennett, 49, of Helston, Cornwall, said: “David Cameron praised my bravery and said people like me make this nation what it is.
“Now I can’t pay my bills.”
Last Friday five disabled tenants lost their Court of Appeal bid to have their benefit cuts ruled unlawful.
They now plan to go to the Supreme Court.
Mr Bryant said: “The Bedroom Tax is cruel and unfair. The Government should ditch it.
“If they don’t, a Labour government will.”
Campaigner Peter Barker, 53, who first found the loophole, said: “There are far fairer ways of saving far more cash than this tax.”
Stuff what the press are saying, stuff what Atos are saying as well. As for demonstrating in London, I am not one bit frightened about water cannons. And besides, if the people demonstrated all over the country they wouldn’t have enough cannons, police, courts or cells to hold the amount of people!
All I can really hope for is that Scotland wins independence – Salmond (no matter what you think of him), has promised that PIP would be dropped, the WCA would be altered towards the sick and disabled and that help would be available towards the people of Scotland who need it! We already don’t have to pay bedroom tax here – as Holyrood are actually making the difference up so no-one has to pay anything extra here. Everything that this disgusting, evil, un-elected coalition does helps the people of Scotland say Yes!
I’d like to know if the staff of Atos, who had no-one demonstrating last week, (I couldn’t believe how few people actually turned out, and how none turned up in some places), are telling people that the demonstrations frightened them or made them uncomfortable, seeing as they weren’t involved! I wonder if someone could find out if any of them are reporting having demonstrators outside their buildings and are in the media about it?

About 60 of us were at the demo on Cadogan, in Glasgow for several hours. I stayed for about 3 hours. Think the demo ended not too long after that.

And before YTS it was YOPS (Youth Opportunities Programme) and TOPS (Training Opportunities Programme Scheme for those a bit older) under Labour. The point is both government’s have always had these schemes ever since unemployment hit one million back in 75 for the first time. But in those days, you could do all sorts of interesting training things, you got a bit extra money for doing them and most important they were voluntary.

Yep, Donkey, but as I said before on TOPS you could so some really good and useful stuff so some of them were like apprenticeships, this would have been about 76. But the key thing is you weren’t FORCED. You were cajoled with an extra tenner a week which in 76 was believe you me a lot of money. Add that on to your Supp Benn which was also worth a lot more and it wasn’t a raw deal at all. Unemployment at one million seemed shocking then but it wasn’t until Thatcher’s monetarism that we saw unemployment rise to 3 million and stay there. Employment was still more secure in those days. It just doesn’t compare with what it’s like today.

i know what you mean and can see why it was attractive then coz it offered some hope of work, and a tenner, a lot of dosh back then….me, i started my apprenticeship in 1968, so i was one of the last lucky one’s, that could sniff snot back into my throat, say gissa job, your loss if you won’t employ me sort of attitude…i trained apprentices, and even if they were full apprenticeships, i had no heart for it, nor did they, they knew no matter what, most would be gone….the apprenticeship scheme was running but with no/rare jobs outcome, even back then, but we all had to try to get them taken on…they were no different as human beings to me no less potential than me, except there would be no job for them at the end of it….much much much worse now…1000000 jobs short, but people didn’t give a fig for part time jobs, we wanted and expected full time decently paid jobs with prospects, to be created, anything less was preposterous…not part time work…and the dole was decent back then….

Yes, those were the days when people could just walk into jobs and tell the boss to F-Off if they didn’t like the job and walk straight into the next one. I just missed that. Unemployment was just hitting a million when I left school but still decent dole. This is what gets me about the government’s argument – if people just wanted to sit around not working how come when the dole was a decent amount everyone didn’t just give up work and sign on? Just shows the flawed logic of the govt.

Being in the WPP office makes me feel sick and depressed each time. I hate the fucking place, i hate the fucking ‘staff’, i hate the fact that I only et £71 per week and they get an attendance bonus of £250 each time I have to go under illegal threat of sanction, I hate the fact that they pipe out crappy music in the place and I hate the smug office manager who always avoids dealing with any issues or problems I have with them.
The place needs to be shut down asap for taking money illegally whilst falsely claiming £250 per week per client and not doing a fucking thing to help me, except forge links with dodgy recruitment agencies only offering zero-hour contracts and NOT any real offer of part-time or full-time work. bastards.
What about the people yet to be tested (ME). So myself and lots of others will be tested by a company that has no confidence in the system!
I watched a video last night and it was actually pretty alarming as in the ‘Big brother is Watching you’ type Orwellian nightmare. It’s all to do with this Universal Job Match garbage. A guy got his JSA sanctioned because they checked and looked into how many times he had logged on to that site to look for vacancies. They said he hadn’t logged in to look for the rquired amount of times and so he wasn’t trying hard enough to get a job!
The guy said that was total BS he’d logged in tons of times, he’d been for an interview just a few days before and had sent his CV out to zillions of different companies.
The bar has been raised to a level that people can’t reach any/more as far as pre-conditions for receiving benefit. It’s totally scandalous what this country has become.
The alarming thing is that Universal jobmatch is a thing where they can log in and check all your movements in your account and everything you’ve done. That is truly revolting. I looked at a job there one time and wanted to find out how to apply for it so clicked the button and it told me i had to make an account. I smelt a rat straight away and thought “this is just a ruse to track you and find out everything you’re doing”
They should get done for infringement of human rights.
European law clearly states that it is an offence for anybody to remotely track an individual user’s online account. Tell your advisor that they are breaking the ECHR and the DPA 1998.
Jobmatch toolkit is your first line of defence against what your JCP is claiming. Nowhere in the official UJM guidelines does is state access must be given freely.
Each JCP does not follow official governmental policy. They all interpret the laws according to whomever works there. Each JCP is different and not uniform to what THEY are supposed to do in accordance with their rules laid down to them by the DWP.
OT I know so I do apologise. Anyway, here goes. After 6 months of (much needed) employment my contract came to an end on the 15th Feb. On Monday 17th Feb I made a new claim for JSA. Today I had to attend an interview. It seems in the 6 months I have been away from the JC the ‘rules’ have changed.
I took with me a copy of my previous Jobseekers Agreement. ‘Oh no, we no longer have those agreements. We now have comittments!!’ Fair enough. I would still ,like to look for the same kind of work and the same hours. ‘Sorry, that’s all changed. You must be availablle to for work at any time of day’
Plus, it’s no longer about numbers. It doesn;t matter how many jobs applied for or CV’s sent out. It’s all about ‘prospects’ I asked for her to define ‘prospects’ and she said it is down to individual advisers who will assess my ‘prospects’ every 2 weeks and decide whether or not I have tried hard enough.
So no real guidlines. No targets. No actions. Just the whim of the adviser!

The way unemployed and dissabled people are treated in this country is disgusting. Try that in Franch and EVERYONE affected would protest together and make things impossible. This country plenty moan about things but do nothing about it. Everyone needs to complain to the right people every time.
What I would like to see is those that caused people to suffer or take their lives because they couldn’t cope held RESPONSIBLE. I know its a word not understood by government unless it applies to someone else but we can live in hope if not comfort.
Great news now the big questions are when is people going to get their backdated money!?

Wayney, Atos do PIP assessments in some areas and also they pulled out of reassessments of ESA so they could clear the backlog before handing over to Maximus as I understood it.
no it was Atos ok I have recently failed my first appeal
despite ten years of abusive ignorance against people with genuine disability’s
my GP supported me yet they still ignored my appeal evidence
the missing document esa50 which they used was from my first assessment that failed to be executed because of the dwp and finally upon my fifth appointment for a esa medical they failed to provide me an esa50 which I believe voids the assessment medical report because my disability changed I am administering higher dosage medication and its all about the money
however to me its all about everyone’s right under the disability’s I suffer to be treated as equal under the equality act 2010
I have one more appeal when this fails which would Be because they are corrupt and don’t want to give me my rights alike others
I have a gay friend whom split up with his partner and cried wolf instead of moving on now he gets esa how discusting and ignorant to people with real disability’s and their rights as a disabled person entitled to nothing in life because the system is too busy feeding the wrong kind of none disability applicants instead surprise me then I will be rid of the statutory system hello EU common law I will be alike to rest of the nation I will not pull out of the eu by voting out because our human rights are the prime reason for this and I think disabled people have lost enough if not their own life because of these corporate manslaughters
