The True Horrors Of In-work Benefit Sanctions Have Not Yet Been Understood

sanction-sabsSo called hard-working people will soon be abandoned to unprecedented poverty when payments intended to cover housing costs are sanctioned for the first time under sweeping reforms to in-work benefits.

When Universal Credit is fully introduced (stop laughing) part-time workers on a low income will be expected to constantly look for more, or better paid work as a condition of receiving vital in-work benefits.  Any failure on the part of claimants to prove that they carried out constant job searching in the hours they were not working will mean benefits are sanctioned.

For claimants who are unemployed the sanction system will remain largely unchanged under Universal Credit.  Those without health problems who are sanctioned will lose all of their personal benefits except what is required to pay for housing costs or children.  This will mean a childless claimant will have no money at all once they have paid their rent – although they may be eligible to apply for emergency Hardship Payments of around £40 a week.  It is this nasty regime that has led to the explosion in foodbanks and been linked to a growing number of suicides.

If this same claimant is in part time work then they may not receive any additional benefits other than the housing element of Universal Credit – the replacement for what is now known as Housing Benefit.  And so, for the first time, it is this benefit which will be sanctioned should they fail to carry out Jobcentre demands to look for additional work.

Working claimants who are sanctioned will lose the same amount as those who are unemployed  – the equivalent of a current weekly dole payment of £71.70.  That means if some is working on a low income and claiming help with their housing costs then £71.70 will be deducted from their benefit.  To see the full horror of how this will play out in some people’s lives then you have to do some sums.

Take a single, childless person in Bristol working at the current minimum wage for 20 hours a week and paying £120 a week in rent – the local housing allowace rate in the area for a claimant over 35.  Under Universal Credit this person will have a weekly income of £244 made up of £144 a week in wages and £100 a week in benefits.  Once their rent is paid this will leave them with £124 a week.  If they are sanctioned however they will lose £73.10 leaving them with just £50.90 a week to live on.  That’s over £20 a week less than the current dole and just £10 a week more than Hardship Payments.  Universal Credit will therefore not make work pay for those who have been sanctioned.  It will however make work compulsory.

The claimant will not be able to leave their job without risking a disallowance – meaning no benefits at all.  In the hours they are not working they will still be expected to carry out work related activity to look for a better job, which under current rules, could include some form of workfare.  The meagre income they receive means they will be unlikely to qualify for additional Hardship Payments.  And astonishingly they are also likely to have to pay Council Tax out of that sum.
In Bristol they would be expected to pay around £9 a week in Council Tax assuming they lived in the lowest possible band.  This brings their weekly income down to about £42 a week – and they are working.

A weeky bus pass in Bristol costs £23.80.  Claimants must be prepared to travel at least 90 minutes on public transport to their job so in most cases this will be a necessary expense.  This will mean hard working people surviving on less than £20 a week for food, clothes, basic hygiene costs and bills.  That of course assumes they aren’t subject to the Bedroom Tax in which case they will get no money at all in some cases, just a steadily increasing debt.

The only real option for most will be to dig into money intended to cover rent.  For working claimants a sanction will mean inevitable rent arrears – and as a sanction can last up to three years – for many it will mean homelessness.  And therefore eventual joblessness.  And with no benefits because losing their job will have been deemed to be their own fault.

This system is designed to ‘incentivise’ people to look for more, or better paid work.  So imagine, by some fucking miracle, that an in-work benefit sanction doesn’t destroy someone, it motivates them.  That they pull their socks up and by some other fucking miracle manage to find an additional job which doesn’t clash with their existing hours.  Let’s say they gain an additional 10 hours a week work on the Minimum Wage.  Will it make any difference?  Barely, because the sanction will still apply unless they have been working full time for a period of six months.

Much of their additional wages will be eaten up by housing costs as their already sanctioned claim is reduced the more they earn.  So somebody working 30 hours a week, with a sanction, in the cicrumstances described above, would receive a total of £207.68 a week in wages and no Universal Credit at all.  After rent and Council Tax is paid that will leave them with £77.  Less than a fiver more than the current dole.  For working 30 hours a week.

There is nothing particularly special about this claimant’s circumstances other than that they live in the south of England where rents are higher.  In London and other areas many will fare even worse.  There should be no doubt about what these sanctions are intended to do.  This is the bureacratic annihilation of an individual as a message to everybody else that if you do not comply – that if you do not constantly strive – the government will destroy you.  It is like nothing that has been seen in UK legislation since the horrors of the workhouse.

According to the DWP benefit sanctions are only used as a ‘last resort’.  There have been 1.6 million ‘last resorts’ since the system was toughened in 2012.  In work benefit sanctions are already being trialled in some parts of the UK with desperate results.  The extension of this brutal regime will create in-work poverty that has rarely, if ever, been seen before in the UK.  People working for pennies, with no quality of life at all. Those already living in the cheapest possible accommodation that can be found in most of the country facing homelessness.  Some of these people will be ill, wrongly found fit for work by Atos or Maximus.  Some will be left with no money at all depending on if they are subject to the Beneift Cap or Bedroom Tax.  Others will have debts they will never hope to pay back whilst sanctioned and so will just get bigger and bigger.

An in-work benefit sanction for many will be a life sentence, especially for those who are older and carry any debts incurred into retirement.  For others it will be a death sentence as the strain of extreme poverty, hard work and constant Jobcentre harassment pushes some over the edge.  DWP ministers are happy to accept this collateral damage as part of their attempt to dicipline the working class into accepting a life of hard-working drudgery for poverty pay.  The only question that now remains is will the trade unions, charities and others that have cowardly accepted vicious welfare refoms continue their co-operation when it is their own workers and members who are subject to this torment?

  1. Has in-work conditionality been applied anywhere else in the world? America as far as I know, not exactly the most sympathetic country in respect to benefit claimants, has never used in-work conditionality even though it time-limits welfare. Does anybody know if any country on the planet has tried to impose sanctions based in-work conditionality on its poorest working citizens?

    • The Work and Pensions Committee says the employment support service for in-work claimants of Universal Credit (UC) holds the potential to be the most significant welfare reform since 1948, but realising this potential means a steep on-the-job learning curve, as the policy appears to be untried anywhere in the world.

    • I think this is the only country in the world doing this to in – work claimants, you couldn’t make this crap up could you.

      • Thing is most jobs aren’t round the corner from your home and involve travel to get to, which makes it very hard for most people to juggle multiple part-time jobs unless they’re willing to work during the day and evenings or during the evenings and at night. With two jobs say, you’d have to get from home to your first job and from there to your second. At present the Jobcentre says you have to be willing to travel for up to 1.5 hours to get to a job you can do so if you have more than one job, involving several journeys, you’re going to end up with one hell of a long working day with bugger all reward at the end of it.

        Surely time constraints and travelling costs render in-work conditionality a laughable impossibility? How could such an utterly crap idea be workable in the real world?

        • I have 3 jobs, work 44hr a week, travel to work on the bus or by foot and i am a single parent, If you want it, you find a way to do it. there is no excuse not to find work.

            What about if you’d rather spend time with your children than flip burgers? Or chat to your elderly mother than spend hours each day on your phone on a bus between jobs.

            Im not saying yourlifestyle is wrong, if it makes you happy thats fine. But its not for everyone and no-one should be forced into it and still struggle to heat and eat

          • How much time do you spend travelling between home and work and between job and job? And that bit about “… there is no excuse not to find work…” is bollocks. The availability of work varies geographically and is not homogeneously distributed across the UK. If you are older, or younger, or have a health problem, or – basically for any number of reasons – you may not be able to find work or may be denied work.

            If you really believe what you say I’m surprised you have managed to get three employers to offer you part-time work because your an idiot. Why aren’t you good enough to work a full week with one employer? What actually do you do in your trio of jobs?

          • If you’re child/children are young I would call you a negligent and a piss poor parent to be away from them for so long. What is you’re work pattern? If you do pretty much a whole day with each employer during the week that’s no different from a full-time job i.e., one journey to and from each job per day. What is being discussed here, I think, is the difficulty of visiting two or more workplaces, possibly quite far apart, to try to make up the hours equivalent to one day’s pay on the minimum wage. Which is quite different. Four hours here, two hours there and another couple of hours somewhere else with longish distances between each job and home for a minimal wage represents a really shitty way to live your life, as well as a low paid and unrewarding one.

            Come t think of it, based on what you’ve written, maybe you child/children are better off seeing you as little as possible and brought up by someone a lot kinder, more sensible and more humane.

            I recommend you take on as much overtime as possible.

    The number of benefit sanctions imposed on people with mental health problems has increased by over 600 per cent over the last four years, Department for Work and Pensions statistics show.

    A joint analysis of the figures by the Independent and the mental health charity Mind found that 19,259 people with such conditions had their benefits stopped under sanction in 2014-15 compared to just 2,507 in 2011-12 – a 668 per cent rise.

    The finding comes weeks after ministers rejected a call to investigate whether such sanctions – which involve stopping a person’s disability benefit income for weeks at a time to enforce compliance – are damaging to mental health.

      I think that could well be the tipping point. Why else would the government be desperate to keep interest rates at such historically low rates, even though it affects the incomes of pensioners who would probably tend to otherwise support the Tories? It must be because the Tories realise that any significant increase in interest rates would start to affect not only those in debt, but able to manage things at the moment, but would also lead to high inflation as companies sought to cover their repayments on loans taken out when interest rates were very low. Desperate people do desperate things, and more people are going to get increasingly more desperate, unless things change, and change soon. Low interest rates can’t last for ever, and even if they increase to ‘only’ 5% a lot of people are going to be very desperate indeed.

    Officials have removed from the reports any references to the specific events that triggered an investigation, as well as dates, names of claimants or staff and locations. Several of the inquiry reports have been stripped of almost all data.

    But a number retain entries under the heading “Lessons learned”. Collectively these show that investigators examining the links between a claimant’s death and their treatment by local DWP officials uncovered persistent problems.

    They found frontline officials were often unable to identify potentially vulnerable claimants, failed to deal sensitively or appropriately with them, or anticipated problems they may have negotiating their way around the welfare bureaucracy.

    Investigators found, variously, that communication between officials and vulnerable claimants was often poor, that practice guidelines were not followed, and that benefits staff often rigidly adhered to the rulebook rather than using “common sense” in their dealings with claimants.

    In two instances, investigators reported that it was difficult to carry out a proper inquiry because DWP records had been purged, or not kept properly. In another instance the investigator concluded that officals precedural actions were followed correctly and could not have prevented the death of the claimant.

    Other peer review findings include:

    • Local DWP branch officials should be given awareness training to deal with “customers who made suicide/self harm declarations”, one report urges. It concludes: “In learning from this experience it is clear there is work to do”.

    • In one local office staff failed to provide adequate support for vulnerable claimants, according to a report. It says: “It is clear that we had several opportunities to identify and address the errors made over the duration of this claim, but we neglected to do so”.

    • DWP staff who decide on whether to award or disallow disability benefit claims should always consider the claimants’ full historical case files and medical history, a report concludes, to “minimise the risk of withdrawing benefit inappropriately and placing a vulnerable claimant at risk”.

    It is understood nine similar DWP peer reviews have since been undertaken since August 2014 and are subject to further FOI requests.

    In the end this is down to the British people. If they want to live like slaves in a neo-liberal Tory state, while eating their dinners in front of the TV, and arguing about the X-Factor, then they can look forward to many years of the same. While the Tory elite, the rich landlords and zero-hours employers party like there’s no tomorrow.

    Sanctions for many people is like a nuclear bomb going off in their lives. Having experienced it myself I can tell honestly it ruins everything because it puts you in debt, so you don’t eat, you don’t wash or keep warm as you can’t afford any heating. You don’t bother getting out of bed as there is no point. Finally you become ill and isolation becomes your only companion. I nearly topped myself over this experience, but my family saved me.

    Together with cuts to accessing to legal aid, little to no access to benefits advice and support, life for claimants is being made impossible. Clearly calculated into the benefits system by Tory cunt government ministers, the strain, especially for those who are disabled, old or have debts, will obviously destroy benefit claimant’s lives. On top of this, throw in some nasty Jobcentre Plus bullying and harassment tactics to fatally grind people into the ground will result in many more suicides.

    With no accountability from the Tory government over thousands of claimants deaths already, coupled with general disinterest from the British UK public, is creating a perfect storm for the destruction of many more lives.

    Sorry, but how is this any different to a part time worker under JSA who is subjected to exactly the same thing and has been for years (including having the work programme and workfare inflicted on them)? All that is truly different under UC is that anyone earning above the single or couple rate of JSA and claiming any other benefit (such as rent) will be dragged into the joke centre and forced to face a swivel-eyed psychopath, just like part time claimants under JSA have been for a long time.

    Monetary- wise JSA part time workers have had to live on their meagre wages during a sanction way before the idea of UC came along, so “in work conditionality” and sanctioning people in work really is not new. What is new is that the DWP are going to widen the net and scoop up everybody else who isn’t subjected to their pointless and vindictive sanctions regime.

  27. If they want people to be in work, rather then claiming benefits, the right way to go about it is

    1-The working wage to by law be enough that benefits are not needed for anyone in work.
    2-Each employer to be forced to employ a quota of the less desirable employees by law (disabled people, people with minor criminal records, old people, women of childbearing age, trade union members) so that only the truly unemployable don’t have a job.

    That would cut the benefits bill by about 80% without leaving anyone with no money.

    Ministers have refused to say if they implemented 10 measures – recommended by their own civil servants – that would have made it less likely that “vulnerable” benefit claimants would lose their lives.

    The 10 recommendations were taken from some of the 49 heavily-redacted, secret “peer reviews” that the Department for Work and Pensions (DWP) finally published this week after losing a 21-month legal battle with Disability News Service (DNS).

    Although key parts of the peer reviews are missing, DNS has found 10 key recommendations for national action to improve the way the department treats vulnerable benefit claimants, many of whom will have mental health conditions or learning difficulties.

    Many of the 49 reviews relate to the process of applying for the out-of-work disability benefit employment and support allowance (ESA)*, through the much-criticised work capability assessment (WCA) process.

    And many of the reviews – 40 of which refer to suicides – relate to the ongoing process to reassess long-term claimants of incapacity benefit (IB) through the WCA.

    The question of whether the recommendations were acted on could provide crucial evidence for calls – led by the Scottish-based grassroots group Black Triangle, and backed by many other disabled activists – for former work and pensions secretary Iain Duncan Smith to face a criminal investigation for misconduct in public office following his refusal to address a coroner’s concerns about the safety of the WCA.

    They want to hold Duncan Smith and his former employment minister Chris Grayling to account for their failure to improve the safety of the WCA, even though they were warned that it risked causing further deaths.

    The Department for Work and Pensions (DWP) has finally admitted that it could be partly responsible for the deaths of some benefit claimants.

    The admission came – quietly – after its release of heavily-redacted versions of 49 secret “peer reviews” into benefit-related deaths, following the loss of a 21-month battle with Disability News Service (DNS) to keep them secret.

    Although the circumstances of each death are redacted, analysis of the recommendations for local and national improvements suggests strongly that the DWP civil servants who carried out the reviews believed that the way the benefit claimants had been treated had been partly responsible for many of the deaths.

    One peer review author says: “The risk associated with disregarding the possibility that some of these claimants need more support or a different form of engagement is that we fail to recognise more cases like [REDACTED NAME OF BENEFIT CLAIMANT WHO DIED], with consequent potential impact on the claimant.”

    “Processes… have been revised to ensure it does not happen again, to make sure we provide adequate support for vulnerable customers,” says the author of another review into a claimant’s death.

    The fight to prosecute Tony Blair over the Iraq war is heating up

    Over ten years ago, a cross-party group of MPs led efforts to impeach Prime Minister Tony Blair for taking Britain to war in Iraq on false pretences. Now, with the Chilcot Inquiry into the invasion set to come out in July, there have been renewed calls for Blair’s prosecution.

    Former First Minister of Scotland Alex Salmond led SNP opposition to the Iraq war back in 2003 and was involved in the opposition attempts to impeach Blair. Now Foreign Affairs Spokesman for the SNP, he has expressed his desire for international criminal proceedings against the former prime minister to begin as soon as the long-awaited Chilcot Inquiry is released.

    Salmond says:

    If Chilcot finds – as I hope and believe he shall – that Blair pre-committed to war in the Crawford Ranch in 2002…, in my view everything that happened after that was a fabrication in order to provide a justification for a decision that had already been made… So that’s dodgy dossiers, slanted intelligence and a whole panoply of deception that was designed in order to justify that original pre-commitment…

    According to memos from former US Secretary of State Colin Powell which were released in 2015, Blair had offered his “strategic, tactical and public affairs lines” in order to “strengthen global support” for war in Iraq a year before it actually began. This revelation appears to back up Salmond’s talk of a “pre-commitment”.

    The government’s own statistics show that between 2010 and 2011 10,600 sick and disabled people died within six weeks of their ‘fit to work’ assessment by Atos and the DWP. If a company gets rid of a pregnant woman-make them pay her salary for 18 years or until she finds a new job, whatever happens first.

        Councillor Fraser McAllister said East Lothian Council already had one of the worst rent arrears debt in the country despite charging one of the lowest rents. He said the new credits gave those in need less and put them under more pressure.

        He added: “We are living in a high-cost, low-wage society. It is an experiment and like all experiments there are unknowns but one of the most definite outcomes is that the poor and most vulnerable in our society will become poorer and more vulnerable. It is an experiment in cruelty.”

        The new system means the council faces having to collect an additional £8.3million in rent from tenants rather than relying on the money coming in automatically.

        Kenny Christie, council service manager for revenue, admitted his department was already “feeling the strain” of the new system.

        And he said claimants were already making tough choices, saying: “We are seeing evidence of it already. People are saying ‘I did not pay you [rent] because I had to put food on the table’. That is the reality. It is a significant change.”

        The Department for Work and Pensions said anyone experiencing difficulty should contact JobCentre Plus in Musselburgh. A spokesperson said: “Short-term support is available to cover any delay and we are offering personal budget support and can direct people to various money advice services available if there are concerns.”

    It is well known, surely ? that stress exacerbates any illness, claiming benefits is incredibly stressful, especially with all the additional complications caused by them changing the rules, changing the way you claim, what you may or may not be entitled to etc. Then you also have the added stigma from society and the media for being a benefits claimant. So it does not surprise me in any way that people cannot cope and when all avenues they see open to them closing in front their eyes, even an appt. at the GP taking 3 weeks and then when you get to see GP if you are lucky enough for them to even count you as a person with a real problem and they refer you for psychiatric help you will then have a further wait of 3 plus weeks before even getting an appt. That appt. can then be another 3 weeks away and that’s only for an assessment. Trying to cope and sort all this when you are struggling mentally is hard enough, for some impossible.. but add in a physical health issue as well and add no money and piles of unpaid bills due to all the benefit cuts and it is no surprise people choose to take their own lives. SO government.. do not tell me the benefit cuts and changes are not responsible for the increase in benefit claiming suicides.. You are lying.

      The Tory woman in town went mad, really mad, saying it was offensive and not true and how much of a good prime minister David Cameron is.

      minutes later the police arrived and they told her off for wasting their time and said they would fine her next time she phones them for no reason. They then moved her along then they had a chat with me about how David Cameron had divided this country. They also asked if I could get them a shirt as they would happily wear it themselves.
