A woman who founded a charity to help people suffering with chronic pain committed suicide after a battle to claim disability benefits ended with the DWP demanding that she repay £4000 in backdated payments.
Julia Kelly was just 39 when she took ker own life at the end of last year. In an inquest into her death the Northampton Chronicle reported that the coronor believed the “upset caused by the potential withdrawal of her benefits had been the trigger for her to end her life.”
According to a statement made by her father at the inquest, Ms Kelly had attended three tribunals in her attempts to gain disability benefits. Mr Kelly said he “firmly believed” correspondance from the DWP triggered her death adding:
“Not to be believed by the DWP that she was suffering chronic back pain and also to be accused of wrongdoing and be told her payments might be stopped – we believe she snapped and could not take it any more.”
Despite this the DWP made a nasty statement which attempts to suggest she had thousands of pounds and was therefore not eligible for out of work disability benefits. According to a spokesperson for the department “If a claimant exceeds the threshold with thousands of pounds in savings, they may no longer be entitled to the benefit.” It would not take three tribunals to establish how much someone had in savings. There is far more to this than the DWP are suggesting.
The news of the inquest into her death comes on the same day that Iain Duncan Smith said that stopping people’s benefit is ‘compassionate’.

Police officers smashed down the front door of a Mansfield man’s flat after the DWP tipped them off he could be suicidal.
Kevan Ramsdale was settling down for the night in front of his TV with his headphones on when two policemen walked into his bedroom.
Kevan 52, said he was shocked and surprised to see the two men.
Mr Ramsdale who is in the process of making a claim with the Department of Work and Pensions (DWP), said: “I was talking to someone about my claim being delayed and I asked the woman on the phone if she had seen a Channel 4 Dispatches TV programme the night before showing how many people had committed suicide after having their benefits cut.

His sister, Mickayla Carr, told Burnley Coroner’s Court Mr McDonald was “a happy-go-lucky person” who “doted” on his five-year-old daughter.

Shocking – do the DWP really think that people would even cross their doorstep if they weren’t entitled to JSA or ESA – they go to sign on to claim benefit they are entitled to and get credit for their National Insurance contributions – nobody would go near them if they had loads of money. Where is everyone’s NI contributions and tax deductions going if it isn’t going to pay welfare benefits then?
Up here on Tyneside we have the highest rate of suicides in England. On Wednesday yet another victim’s body was found washed up on a beach a short distance from where I live, the latest in a spate to hit the area (South Tyneside) in the last couple of years.
It’s hardly a coincidence that the north-east is the jobs blackspot of the UK, where the unemployment rate is still well above the national average, and where many older workers – particularly middle-aged men who are statistically most at risk of taking their own lives – are virtually trapped on benefits due to ageist attitudes amongst employers. Add to that the corrosive culture of intimidation and bullying they are subjected to at jobcentres, with the constant threat of being sanctioned on the whim of some arsehole “work coach”, and it’s hardly surprising that some are pushed beyond endurance into ending it all.
And let’s not forget that the architects of all this misery being inflicted upon claimants are self-professed “Christians” – Blair, Cameron, IDS, et al. Were they not commanded by their faith’s founder to “do unto others as you would have them do to you”? (Luke 6:31). IDS should be forced to explain, using his holy book as the source, how stopping people’s benefit is “compassionate”. He couldn’t, of course, because he’s a total hypocrite like the rest of the callous God-bothering brigade that swell the ranks of his loathsome party.

The DWP like to talk about “thousands of pounds” as if it is a vast sum of money when in actual fact the sum in question was probably hardly enough to pay for the deposit on a new fridge.
IDS must be pleasantly surprised that the JCP work coaches enforced his nefarious whims beyond his wildest dreams and the worst nightmares of claimants.
They either adapted really quite fast, looked around for alternative employment, retired if they could or were got rid of – sink or swim in the swamp.
There seemed to be a lot of moving ‘advisers’ around alongside the introduction of their Stricter Benefits Regime – or moving ‘customers’ if need be – to a more effective ‘Benefits Refusal Adviser ‘ (BRA).
Have been sanctioned by several JCP work coaches in the same office the idea of one bad apple or unique “Benefits Refusal Adviser” is not in my experience.
I think I struck really very lucky at one point (for around a 3/4 month period and before being sent on the WP). Before that, a completely nasty ‘bit-between-the-teeth’ one who tried to issue a sanction doubt at 1st interview … then later on the really, really vicious one who had ‘I Love My Job and My Job is to Cause You Harm’ written all over her … with a few variations of the same in between.
It was only a few short years ago (about 5?) that I signed on for a while and there was not quite ‘none’ of this, but far less. It was Income Support rather than JSA tho’, & was on a different floor of the building – so going ‘upstairs’ in 2012 was a really steep learning curve – to put it mildly. I was aware of an overall change in 2012 with security guards everywhere watching every move/challenging and and running over to issue a telling off at the sight of a mobile phone.
Definitely not just one or a few bad apples now – they’re virtually all rotten to the core or they wouldn’t still be there.
(The after-effects have not gone away 12-15 months on & impact on how I now am at work & more generally). As they say though – supposedly – what doesn’t kill you makes you stronger …
I’m not sure this would be the same exactly if I hadn’t been able to ‘do enough’ – & be lucky enough – to avoid a sanction though – it cost a lot at the time and will stay with me. As people on here have said – impossible to understand unless or until you have been (in) there.

Council contracts worth millions given without correct tendering process, DWP report reveals

A lack of financial controls and the pressures placed on staff led to the controversial Dorset Waste Partnership failing to comply with legal requirements, it has been claimed.
A damning report into the partnership has revealed “serious non-compliance” with both Dorset County Council’s own rules and the legal restraints on all public bodies.
Monitoring officer Jonathan Mair’s report states that contracts worth £765,000 and £808,000 were given to two contractors without any compliant tendering processes.
More than 28 hire vehicles were also operated without their details being passed to the Motor Insurers Information Centre – a criminal offence.
As reported in yesterday’s Echo, Steve Burdis, the director of DWP, has now been suspended from his £70,000 post and is facing disciplinary action.
The DWP, a partnership of seven Dorset councils, sparked concern when it reported an overspend of £2.8m, including more than £1m used for hire vehicles.
An investigation by the South West Audit Partnership has concluded that there were serious weaknesses in DWP’s financial management processes and a lack of controls in place around hiring vehicles.

Mum of dead disabled teen says nothing has changed with care trust

THE MOTHER of an 18-year-old who died under the care of learning disability services in Oxfordshire has questioned the service’s openness.
Sara Ryan spoke out after a Care Quality Commission inspection found that staff and service users were “concerned” about how the Southern Health NHS Foundation Trust was handling Connor Sparrowhawk’s death. It did not detail what these concerns were.
Headington resident Dr Ryan said: “I’m not surprised because the way that the trust handled the situation with Connor was appalling.”
The report, published yesterday, stated: “This was clearly causing distress and affecting staff morale and unrest with people using services and their families.”
Connor drowned in a bath in July 2013 after suffering an epileptic fit at The Slade, a short-term assessment and treatment centre for people with learning disabilities. The unit he died in was closed to admissions in November 2013.

Minister announces consultation on new rights for disabled people after death of Connor Sparrowhawk

PLANS for new legislation following the death of a Headington boy will be announced by the Minister for Health this week.
Care Minister Norman Lamb will announce the findings of a study that could shake up England’s learning disability care system.
Mr Lamb said that the Green Paper – a Government consultation into possible changes to laws – was the result of the “scandalous death” of 18-year-old Connor Sparrowhawk in July 2013.
Connor drowned at the in-patient facility in The Slade, Headington after suffering an epileptic fit in the bath.
An inquest found Connor’s death was “preventable”.

In a bid to turn over a new leaf after the Winterbourne View scandal, the proposed law would give people the right to have a say about where they are cared for. It would include those sectioned under the Mental Health Act.

“CORPORATE MANSLAUGHTER BY THE DWP”
The Corporate Manslaughter and Corporate Homicide Act 2007 is a landmark in law. For the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care.
The Act, which came into force on 6 April 2008, clarifies the criminal liabilities of companies including large organisations where serious failures in the management of health and safety result in a fatality.
The Ministry of Justice leads on the Act and more information is available on its Corporate Manslaughter and Corporate Homicide Act 2007 webpage.
HSE welcomes and supports the Act. Although the new offence is not part of health and safety law, it will introduce an important new element in the corporate management of health and safety.
Prosecutions will be of the corporate body and not individuals, but the liability of directors, board members or other individuals under health and safety law or general criminal law, will be unaffected. And the corporate body itself and individuals can still be prosecuted for separate health and safety offences.
The Act also largely removes the Crown immunity that applied to the previous common law corporate manslaughter offence. This is welcome, and consistent with Government and HSE policy to secure the eventual removal of Crown immunity for health and safety offences. The Act provides a number of specific exemptions that cover public policy decisions and the exercise of core public functions.
Just heard from a mate who got a letter this morning from the despicable and odious ‘WORKING LINKS’ pleading with him to contact them and let them know if he got a job etc. All the details basically they want to know. Could that be so as they can collect their blood money fee? It makes you wonder doesn’t it? Considering this all started over two years ago!
So two years and counting and they’re still harassing this guy at home with demanding letters. It would be interesting to know where the person stands as far as the data protection act. Should a company, that you indicated you didn’t want to contract with them in any way, still have your personal details on their computer system? Surely any details should have been deleted when the said person indicated he wanted nothing to do with them?
Pretty desperate the measures the scum will stoop to in order to collect their fee eh?
This happened to me with ingeus, they. Basically threatened me I’d haveMy tax credits sanctioned if I didn’t co operate with them and attend meetings after I’d signed off. I only ever did induction with them and. Found my job by myself. Then they kept ringing me even after I’d told them back off. I never signed their data waiver. They r all scum. And then they tried to find if . Was still employed 2 years on so they could cash in again..
A Cease and Desist letter sent as ‘signed for’ should sort it all out – once you mention that harassment is a criminal offence punishable by up to six months in prison, and that you would consider any further contact from them as harassment. Keep a copy of the letter, of course, and also the receipt from the post office for the cost of the postage and that it was a signed for delivery. Also, follow up by checking out the tracking on the Royal Mail website, as it will state when your letter was delivered and should have the signature of the person who received it.
If they persist in contacting you, keep a log of it all, and do report it to the police, though I doubt you’ll have any problems if you send them a letter that you can prove you sent, and they received. Should cost you less than 2 quid, which is a bit steep, but probably worth it for peace of mind.
An email can also work – if passed ‘high enough’ up the chain of command and including mention of seeking legal advice regarding what “may amount to harassment …”.

The UC if you earn to much and get your UC cancelled, you can be bared from claiming it again, for I think 6 months, if your earnings go down rule.
Basically if you are on UC, earn a good wack, then hit hard times you will be expected to have put aside enough to carry you over for six months as instead of UC being based on each months earnings, it will take into consideration past earnings as well.
There was an article on insidehousing about it, but I think its now a paywalled site to keep the general public out.

the stab impact is no money, until one is given leave to submit appeal to the FtT….there are circumstances where one can reapply ie it is 6 mths from the initial claim or one’s conditions have worsened, which they obviously will if benefits are stopped…

Regardless of the merits and shortcomings of UC in principle, the constant need to tweak it here and tweak it there in order to cover all possible circumstances will doom it to be an expensive failure. Just as with the tax system, building on successive layers of complexity to cater for anomalous circumstances will result in a huge, inflexible, inefficient behemoth of a system that neither operators nor operands will understand. Epic fail in the making – and all So predictable (and predicted).

Surely this is a penalty for working, or pursuing any type of employment that may only be temporary.
I always thought that benefits covered a specific period of time and that if you did not get enough for that specific period you got benefits.
Of course, Income Tax and Tax Credits are calculated on an annual basis are they not. Is this a means to try and draw benefits in to the same type of regime?

So let me get my head around this… in a self employed situation where someone has been s/e for over a year and the MIF applies.
If the person has a good 6 months and reports on a monthly basis and receives some U/C. Then has a great few months(due to the nature of s/e work) and gets no U/C for 3 months. Then month 10 U/C will either use MIF or the 1st 6 months s/e even though the client has no income from s/e

Recently the CONDEMS brought in leglislation such that people
working part time are expected to seek further hours each week
or face having to suffer sanctions which are a financial penalty
because they are only working part time.
This is a monstrosity unleashed upon the poor / who have already
suffered losing hundreds of millions of pounds imposed on the
unemployed through sanctions in the last few years

This is not the first time IDS has “tweaked” UC and won’t be the last either.
However, the REAL issue is the programme itself which will cost billions more to the taxpayer even in theory yet UC for some unknown reason is discussed as being right in theory when it is not and Raven above starts with “Regardless of the merits and shortcomings of UC in principle,…”
UC – the merging of the benefits and tax systems means EVERYONE will get EVERY PENNY they are entitled to or more simple not a penny more not a penny less.
YET the 2009/10 latest (yes seriously!) figures is £8.34 billion per year in tax credits, WTC and CTC, goes unclaimed but will have to be paid in UC
The last time the benefit non take up figures were released was also in 2011 and for 2009/10 and revealed welfare benefits unclaimed which will also have to be paid in UC – this one stop shop assessment for all benefits. So:
£6.7 billion in HB that goes unclaimed will be paid
£2.2 billion in all forms of IS will have to be paid
£1.7 billion in JSA unclaimed
£2.7 billion in Pension Credit that goes unclaimed
and there is more but that all adds up to an additional cost of at least £20 billion more per year as everyone gets every benefit they are entitled to

It doesn’t sound at all mad as in ‘no madder than anything else that’s already in place’. Particularly if they “have their curtains closed/can afford wi-fi” etc. etc.
It could be enough just to conflate the two concepts – unemployment and the other one – so that the idea is out there and can germinate/take root (so to speak). The vast majority, if not all, DWP and ‘social’ policies were never intended to ‘work’ at the most surface/obvious way (if by some chance they do, it would not have been their first aim). We need only look at and listen to what DWP/IDS and the rest have done and said to date, to know that it is absolutely an ideological propaganda war they want to win:-
So no-one “deserves” anything unless they work for it. Government department(s) to define “work” for this purpose. Even then, they don’t “deserve” it and so it can be removed, in its entirety, for any number of alleged “reasons”. Social security/national insurance contributions and ideologically, an NHS not free at the point of use.
They’ve become so well-versed in the use of ‘extreme’ and previously never-heard of arguments/justifications for their acts – and instilling fear – I won’t use the ‘t’ word. So the ever-widening means of being able to confront/accuse and then punish/cause harm through removal of financial support is an irony too far. Although they’ve evolved a new word to define their (mal) practice – the ‘s’ word – more people now seem very gradually, to be questioning this unethical and in too many cases, lethal, act. Perhaps finally enough people will finally understand and steps will be taken to prevent further escalations?

This is another victim of the Coalition’s murderous system of benefit sanctions to add to the long list of others who’ve died in poverty and despair. Many of them also died at their own hands, ground down and destroyed by this government’s vindictive determination to punish the poor and disabled for simply being poor and disabled.
And the list of victims is a very long one. A year or so ago, Stilloaks on his blog published a list of about 45 people. Tom Pride, Johnny Void and Mike of Vox Political have also published that and similar lists. That was, however, at least a year ago, and there have been many others since. The anodyne statement made by the DWP that it may be necessary for the department to reclaim money that they have overpaid definitely hides the truth about this sad case. Mr Void rightly points out that it should not take three inquiries to establish whether Ms Kelly had the money. I know personally a number of people, who’ve had to fight tooth and nail after the Department mixed up their benefits and kept mixing up their benefits. So much so in fact that I believe this may be a deliberate part of the policy. Just as industrial products have built in obsolescence, I wonder if the system also has built-in incompetence as an additional deterrent to people poor or desperate enough to want to sign on.
