Is This What They Mean By #disabilityconfident? Disabled Staff Twice As Likely To Get Sacked From The DWP

cameron-disabilityOne of the ways the DWP has tried to cover up the vicious attacks on disabled people has been the gushing and cringe-making Disability Confident campaign.

This has mostly involved endlessly tweeting the hashtag #disabilityconfident and organising corporate events where large employers and Ministers all meet up to tell each other how wonderful they are being to disabled people.  Then they can all go back to sending disabled people on workfare safe in the knowledge that the campaign they invented has told them that’s okay.

You might expect however that the DWP’s own treatment of their disabled staff would be exemplary.  This is after all the branch of government which also includes the Office for Disability Issues.  The shocking truth, as revealed in their own research, is that disabled employees at the DWP are twice as likely to get sacked as non-disabled staff and just half as likely to get promoted.

The figures come in the DWP’s annual Equality Information Report which covers the year 2013.  It shows that on every significant indicator disabled staff are treated worse than those who are non-disabled.  Here’s a quick breakdown of the figures:

The DWP employs 95,923 people, with 6.8% of staff having declared some form of disability.

Disabled people were more likely to be disciplined: 2.9% of the disabled workforce at the DWP faced some form of disciplinary action compared to just 1.9% of non-disabled workers.

Disabled people were far more likely to get sacked: Of those that left the department, disabled people were over twice as likely to have been sacked as non-disabled employees.  17.1% of disabled people leaving the DWP were sacked compared to 8.4% of non-disabled staff.

Disabled people were more likely to raise a grievance: 2.7% of disabled workers raised a grievance with the DWP compared to 1.6% of non-disabled workers.

8 .6% of the people who left the DWP were disabled, higher than the rate of disabled employees (6.8%) showing that disabled people were more likely than non-disabled people to leave the department in 2013.

Disabled people were less likely to be given a job: the report doesn’t give percentages of successful applications but they can be worked out.  16.6% of non-disabled people who applied to the DWP were successful compared to 14.2% of disabled people.

Disabled people were less likely to be promoted:  Disabled staff were only half as likely to get promoted with just 0.3% of the DWP’s disabled workforce being promoted compared to 0.6% of non-disabled workers.

Perhaps reflecting this, disabled people were less likely to be in senior roles.  89.8% of disabled staff were in the lowest three categories of seniority compared to 87.4% of non-disabled staff.  On the higher grades disabled people were under-represented at every single level.

And of course, disabled people get paid less at the DWP.  On average across all salaries, disabled people were paid 0.8% less than non-disabled people.

  1. Duncan Smith should hang his head in shame, you could’nt hang him he’s too brass-necked, although by doing so it would put an end to any more of his personal hatred towards disabled people.
    Direct Disability Discrimination on EVERY level regarding employment status/treatment. Where are the Public Information Lawyers to prosecute the DWP? They are getting away with murder.

      Between 2010 and 2013, the government, which has the final say on the assessments, reversed 158,300 fit-for-work approvals by Atos.

      In one case, a dying man with a brain tumour and serious heart condition was deemed fit to work by Atos.

      In another, a vulnerable man with Asperger’s Syndrome, a phobia for food and several other health issues was stripped of his ESA after being judged fit to work by Atos. He later died of malnourishment.

    They reel this BS out like they care and they are helping, Liars.. 2014 and the world is sinking into hell.

  3. Absolutely believe it, have seen it happen, disabled worker treated as if malingering when off sick, told they had too many sick days to be promoted, and finally got rid of. No real adjustments were made except to keep reducing hours. The DWP is not a nice place to work. It got worse when the Coalition came in, before that customer service was at least important, but now it’s being a robot that matters.

    • I know of many cases and the union struggles to support disabled staff… Some examples, an amputee asked to get ‘evidence’ his disability was permanent, a staff member with MS given warning for body language, and someone with anxiety told to explain themselves every day… staff member who was sexually abused as a child and asked it be confidential found that info typed up and 3 of 10 copies left on the photocopier. .. disabled staff are routinely bullied and senior managers do nothing but tell them to go work somewhere else… it’s not taken seriously, and disabled staff are mocked

      HUNDREDS of Commonwealth Games tourists were surprised in Glasgow’s George Square yesterday as disability activists cried shame on sponsor Atos.

      A clutch of demonstrators backing campaign group Glasgow Against Atos held banners and placards aloft — reading “ATOS KILLS” — in front of sports fans who were viewing the Glasgow 2014 sculpture and queueing for Games merchandise.

      IT giant Atos has sought to boost its public profile by sponsoring database software for international sporting events, but campaigners have fought to expose its role in deadly cuts to disability benefits under a lucrative contract running “work capability assessments” for the Department of Work and Pensions.

      Demonstrator Ronnie Swinton told the Morning Star he had come all the way from Dundee to voice his anger at Atos.

      Mr Swinton said he had spent seven weeks “without any money,” depending on friends as he fought to appeal a decision that he was fit for work despite chronic depression.

      Mr Swinton said he had eventually won his appeal but the stress had taken a further toll on his health.

      “I was afraid of losing my flat.

      “It would’ve given me a mental illness if I didn’t have one in the first place,” he said.

      And a government proposal to simply switch contractors won’t solve the problems either, he added: “The whole system’s got to be stopped before any more people die.”

      Several suicides have been linked to benefits being denied following Atos’ assessments, including “Miss DE” in 2011, whose identity remains protected, and blind agoraphobe Tim Salter, who took his own life in September last year.

      The department says it does not record mortality rates for those deemed “fit for work.”

      But figures released in 2012 suggested that 2,200 people had died before Atos had even completed their assessment — and 1,300 had died within six weeks of being shunted into “work related activity.”

      In 2012 Paralympic athletes hid their branded lanyards at London’s Olympic opening ceremony, while Sport Disability Scotland told MSPs in April of athletes who could no longer afford to continue their sporting careers after losing out to an assessment.

      Games organisers have repeatedly said they remain “very proud” of Atos’ involvement, while Atos maintains that its assessments merely offer information to DWP officials who decide on access to benefits.

    The Department for Work and Pensions (DWP) has been ordered to pay
    a woman with Asperger’s syndrome a total of £70,000 after an
    employment tribunal found it to be guilty of disability
    discrimination.

    The Business Disability Forum has reported that the tribunal, held
    in Dundee, heard how the woman was asked to return to work but felt
    that a breakdown in trust and confidence led to high levels of
    anxiety which she was unable to overcome.

    The DWP was judged to have subjected the claimant to harassment due
    to her Asperger’s. The syndrome, which is a form of autism, shows
    no outward signs but can cause difficulties in social communication
    and interaction.

    Many people with Asperger’s syndrome have a variety of skills that
    enable them to thrive in a variety of roles. However, they are
    often disadvantaged when it comes to securing employment because of
    their difficulties with social skills.

    The National Autistic Society said that many employers do not
    realise that people with some autism spectrum disorders, such as
    Asperger’s syndrome, can be highly skilled and qualified as well as
    being extremely employable.

    The tribunal initially awarded damages to the claimant of £54,000
    as compensation for constructive unfair dismissal and disability
    discrimination. In a further hearing, another £17,500 was ordered
    to be paid by the DWP for failing to comply with a re-employment
    ruling.

    Judge Ian McFatridge said that the DWP had “treated the claimant
    extremely badly”.

    “We were required to take into account the fact that the claimant
    is psychologically unable to return to work with the respondents
    and that this is something which has been brought on by the
    respondents’ treatment of her,” he explained.

    A DWP spokesperson said that it acknowledged the tribunal’s
    findings and works hard to ensure that it achieves its commitments
    to good practice in employing and working with disabled people.

    I have a couple of questions,

    1/ Was tax payers hard earned cash used to pay for the compensatory
    awards after the disgusting treatment that you dished out to this
    poor lady, one of your own employees?

    2/ You were fined an extra £17500 for not re-employing the lady
    because you claim the Aspergers Syndrome made her unemployable.
    How many persons suffering from the same syndrome have been found
    fit for work by ATOS HCPs?

    3/ The judge said you treated the claimant extremely badly and yet
    you say you work hard to commit to good practice in employing and
    working with disabled people.
    How many disabled personnel have you made redundant and how many
    are taking/or sought action against you?

    4/ Was there any input from the National Autistic Society when
    formulating PIP examinations or ESA?

    5/ What was the total cost of the case, including specialists and
    lawyers and the tribunal bench and other associated staff?

    6/ Aspergers Syndrome shows no outward signs. How does an ATOS HCP,
    whose qualification and title is not recognised by any medical
    organisation, evaluate on this condition if it is not visible,
    especially if important medical notes have not been submitted in
    the first instance?

    only 9 went to an Employment Tribunal, and of these only 1 was won

    I would like to ask the following questions,

    1/ You state that 146 employment tribunal claims were made against
    the DWP for Disability Discrimination. If 87 have been closed, i
    surmise 59 are still outstanding. Is this correct?

    2/ Of the 87 claims that have been closed, how much money was paid
    out as sweeteners/severance agreements, over and above the
    redundancy payments that were forthcoming?

    3/ By virtue of the fact that one person only(as of now), won their
    claim at tribunal for Disability Discrimination, does this indicate
    that you actively discriminated against a disabled employee?

    4/ How many of the residual 59 have applied to pursue their case to
    tribunal knowing a precedent has been set?

    5/ Was the victor at the tribunal re-employed?

    6/ What redundancy packages are available from the DWP?
    Please indicate levels across pay groups.

    • The DWP, of all employers, needs to set an example when it comes to their treatment of employees with disabilities. Employers’ ignorance of ‘hidden’ disabilities, such as asperger syndrome, is all too often the reason why people with these conditions end up unemployed, so it is extremely disappointing to witness the DWP itself behaving in a discriminatory manner towards someone who has a ‘hidden’ disability. The government might like to harp on about how people with disabilities should be in employment, but there needs to be a massive culture change amongst employers if this is going to happen in reality.

      Recently, the Daily Mail featured an article about Jayne Lutwyche, a woman with ‘hidden’ disabilities who has taken the BBC to tribunal over its discriminatory behaviour towards her.       OK I’ve done some reading.
      The articles about Easterhouse in 2002 only say he was close to tears. Some of them suggest the reason for the visit was really campaigning for tory votes.

      Tower Block of Commons 2010, and Benefits Street, were both done by the same company ‘Love Productions’.
      This seems to show there was a lot of communication between IBS and Love Productions at the time of TBOC.

  11. Off topic but if anyone has an alternative to signing up to a claimant commitment I would appreciate it. Once I’ve signed the claimant commitment it will replace my jobseekers agreement and put me at the mercy of jobcentre staff making me jump through all kinds of hoops. Do I have any way of avoiding signing up to a claimant commitment?

    • The old JSA system is being phased out by the bald Nazi IDS. Once we all get onto the new system we are then simply heading into the gates of oblivion with no escape or saviour.

    Laying there for over an hour, a neighbour chanced upon him and helped him up and rang an ambulance.

    The European Convention of Human Rights does not give an automatic right to receive
    benefit. Where a State does provide benefits, there is no right to a particular amount. The
    Government has set the rate of benefits at an amount that it believes to be reasonable, and to
    ensure that no individual suffers destitution. This is compatible with the Convention.

    “Debbie’s argument is very powerful, inasmuch as the DWP state that the benefit you receive, is the amount that the law says you need to live on………………
    Therefore the DWP, when invoking a sanction against someone, are fully aware that the aforesaid persons life is at risk.

    The DWP have been asked on numerous occasions to pinpoint the law that actually states this and have always come up empty handed supplying an answer, preferring to be vague and make out it is contained in many laws.

    When applying a sanction they are consciously aware that the decision could result in death, therefore the decision maker is culpable and should face prosecution.

    Mistreat an animal and face the consequences, mistreat a human being that leads to death and this is totally acceptable, or is it?

  22. Today was the day when all of the entire SEETEC computer networks crashed and failed completely, leaving every single computer used by staff and customers totally knackered.   26. Looking through the claimant commitment booklet I was given today that has enough pages for a few months, it appears that we have to describe two different efforts we are going to make over the next fortnight to find employment. Can we use the same questions every fortnight? lol

      The Claimant Commitment is where key information will be recorded about the claimant’s availability for work, the types of work they are most suited to do and the high level regular work search activities the claimant will do to help them find and keep a job.

      There may be times when the claimant has recorded their activities to the same standard in a different format. In cases like theses, the Work Coach and Assistant Work Coach should then encourage the claimant to revert to use of the My Work Plan booklet.

      However, this booklet is not a mandatory product for demonstrating evidence of work search and claimants have the right to demonstrate what they have done to look for work through whichever means they deem suitable and most effective.

  28. That’s interesting super ted. When you sign fortnightly does your advisor ever question your efforts or does he or she just accept it?
    I heard today that if the advisor thinks a claimant isn’t doing enough they can suspend benefits before a decision maker looks into the doubt. That would leave the claimant with no money and having to rush to the council to make a new claim for housing benefit or build up rent arrears.

      In the rush to sanction doubt there is any legal diligence between the doubt being raised and the sanction being enforced.

      In any case from doubt to appeal the DWP do not adhere to the process of law they make it up as the go along.

      I was told at Jobcentre (Bradford) that Sanctions are at the discretion of the Adviser, but that I would not be Sanctioned so long as I brought solid evidence of jobsearch activity/applications at each signing appointment. True, people can get Sanctioned for other things, like refusing to do MWA, etc, but you will sail through the signing-on ordeal IF you bring evidence. And I was told this despite the fact that I do not use UJM nor do I allow them access.

          Same here, I don’t use UJ at all, just use C.V. Library and take screen prints to back up my Job log (ES4JP). I’ve had no probs doing this, although occasionally I get asked why I won’t use UJ – I tell them that there’s no point as 90% of the jobs advertised on there are ‘Fake or Scams’ and the few genuine jobs are poached from other websites.

            Does that mean that you have not yet been forced to sign up to the claimant commitment that will eventually replace your jobseekers agreement. It’s being rolled out around the country and will soon be compulsory for everyone. The days of just taking in photocopies are numbered and the way they ignore the rules benefits can be suspended and even if you are in the right it would take a few weeks at least to get benefits reinstated. I did notice a list last week somewhere online that stated what parts of the country the claimant commitment had started to be put in place. Before I attend again in two weeks time it would be good to know if anyone managed to avoid making their CV public on UJM as one of the things I am supposed to do according to the booklet.

    When you say you don’t have a claimant commitment booklet does that mean you have not signed the claimant commitment and are still under your jobseekers agreement conditions? I had to sign up to it this week and given the booklet that I have to fill in and the advisor told me that they are gradually bringing it in as it used to be just for new signings but not it will be forced on all jobseekers.
    Inside the first page they have a box that has to be ticked that says that I have to sign up to UJM which I did ages ago but it also states that I must have a public CV which up until now I have kept private.
    It would be interesting to know what people on the claimant commitment have done when it comes to making their CV public on UJM. Have they gone along with it or refused and faced any consequences.?

      I can’t remember signing a claimant commitment, and haven’t been issued with any booklet. A while ago, last year shortly after completing the Work Programme, I was asked to sign something saying I was now expected to spend 35 hours a week jobseeking, and I already have a UJM account (well, 3 different ones, but can’t log-on to any of them!). I have refused them access to UJM and simply present my evidence in printed form.

    • I made my CV public last October. Since then I have only been invited to apply for one job. This was as a graduate trainee – I completed my post-graduate studies 30 years ago this year. You may ask why I am not working. My job evaporated like the mornng mist last year and since then I have encountered “ageism” and feeble excuses from both employers and agencies. Work until 70 – dream on!
