The Nastiest Shambles Yet, Quarter Of A Million People Awaiting New Disability Benefit Decision

atos-professionalsPersonal Independence Payments (PIP) have lurched even further into chaos with over quarter of a million people waiting months on end for a decision on the new benefit.

PIP is Iain Duncan Smith’s replacement for Disability Living Allowance, the benefit paid to many disabled people to meet costs associated with mobility or care.  The new system launched for new claims in April last year and means sick and disabled people will be forced to attend demeaning and stressful assessments carried out by the notorious Atos and bungling Capita.  The purpose of these assessments is to strip benefits from a fifth of disabled people.

335,000 people have claimed the new benefit since it began last year, but appallingly only just over 80,000  have had a decision made on their claim.  Some people have been waiting for months.  In August last year 95,500 people had claimed Personal Independence Payments meaning that the wait for some has been around eight months and counting.

For people on low incomes this wait will be devastating.  Many PIP claimants will be newly disabled, or will have faced an existing health condition becoming significantly worse.  Some will simply not have the money to pay for care or mobility until the DWP can get their act together.  This delay will mean people trapped in their homes, or going without vital care at a time in their lives when they’ve really got better fucking things to be dealing with.

Atos recently pulled out of similar assessments for out of work sickness and disability assessments and know only too well that most medical professionals are far to ethical to involve themselves in grubby benefit tests that harm people’s health.  It is possible that much of the shambles is down to a failure to recruit enough healthcare professionals who have no desire to be part of Iain Duncan Smith’s horrifying attempt at destroying disabled people’s lives.

Whatever the cause the disaster that PIP has become shows just how much the safety net of the welfare state is being swept away by a combination of callousness and incompetence.  If you become sick or disabled, and need the help you’ve already paid for to live an independent life, then expect to strung along for months and treated like dirt by the DWP.

  4. I agree with everything you’ve written here, except for one thing: I finally received my dreaded brown envelope from the DWP today. I received Enhanced rate for both Daily Living and Mobility, and they backdated it to the date I requested the form (April, 2013). I’ve already received the money. It is an absolute godsend, as after my experiences with DLA (horrid assessment, turned down, went to tribunal, 9 months living off friends before I got the money), I was expecting the worst. I procrastinated massively about getting the form back to them (my mental health condition causes me severe problems with anxiety), and only had my assessment in early May, 2014. The assessment itself was far better than the WCA for DLA and ESA. Also, I have a part-time job, and that doesn’t appear to have affected my claim (although I work from home 90% of the time). I’m in the East of England, if that helps…. So, pleasantly surprised, in my case, but from the statistics, it appears that my case may be anomalous….

    • I think to be fair not every case is a horror story and after the DLA debacle they couldn’t realistically get any worse. The inherent problem is largely public perception and tarring everyone with the same brush; for example I could name/shame several individuals who spend the majority of their disability in a Wetherspoon’s each day/every day. They clearly are able bodied and capable of doing something. Is it any wonder that some would argue their taxes are funding scroungers; in these cases obviously not. But the problem is how can the DWP differentiate between the genuinely needy and those taking the piss?

        How do you know these people spend the majority of their ‘disability’ in Wetherspoons every day, unless you are also there at the same time every day?         • Before I got my part-time job, I spent a large amount of my time on a sofa at my local. I rarely drank alcohol, but sometimes I did. I was incredibly isolated, unable to go very far, with few friends because I couldn’t get out to meet people. I was lonely and depressed. I went to the pub because it was very close by, and at least there I was around people. At times I did drink a lot, because I was horribly depressed, and drinking was an escape, as it is for many non-disabled people.

          I still go to the pub occasionally, to attend a regular pub night with friends, or to meet up with friends. The pub is fairly close to my house, and my friends and the staff know about my disabilities and make sure that I get the most comfortable sofa, etc. Often it is the only time I see people in a week, apart from my one work meeting. Many of my friends buy me a drink here and there, or help me to buy dinner, because I’ve been too poor to do so on my own.

          My disabilities are very variable. About 75% of the time I can’t make it out because my pain or mental health problems are too bad. The times I do make it are my good days. If you didn’t know me, you’d assume that I’m always having a good day, because you don’t see me when I’m unable to leave the house, or my bed, or when I’m having a crisis and can’t even take care of myself.

          I’m always in pain, always dealing with my mental health issues, but when I can get out, I try my hardest not to show it and to act like a “normal” person. Partly this is because I want to be treated like a normal person as much as possible, and people don’t generally treat you like a normal person, or even want to get to know you, if you’re always talking about or letting your problems show. Partly it’s because my disabilities are chronic conditions, and after a while you learn that the more “normal” you act, even if you don’t feel it underneath, the less you focus on them, and the easier it is to get on with life.

          Don’t presume that you know what’s going on in the lives or bodies/minds of disabled people. You have no idea unless you know them very well.

Yesterday (the 7th) I got my application form back w/ a letter stating that I hadn’t signed it, and it needed to be signed and returned by the 19th of June, or I wouldn’t be eligible for PIP. I kicked myself for such an idiotic oversight, wondered how they’d made the decision anyway, and flipped to the signature page… To find that I had signed and dated it. Properly. WTF? I checked my bank account. The back payment that was supposed to have been credited to me on the 5th is nowhere to be found. Now I’m on tenterhooks, wondering what’s going on, and if I haven’t *actually* been granted PIP. Also, I spent £30 that I wouldn’t have spent this weekend (taxi to and from a friend’s house, a take away, and a beer) because I thought I was safe and could celebrate. Now I’m left with £61 to live on (and care for my cat) until sometime after the 19th…. Or possibly never. Argh! So anxious and stressed out now!

    They certainly are “The Nastiest Shambles Yet”. This is the worst and nastiest Government I’ve ever known anyway, and I’m the wrong side of 50. If this was America I think there’d be an armed uprising/Civil War but if we did that here we’d get immediately slaughtered/arrested in no time, and we don’t even have right to bear arms in England. I can still remember how to make those bamboo cane throwing arrows we made as kids though! Talk about David and Goliath.

      Can’t say that it won’t happen though – but I think people organising in grass roots worker organised unions like the IWW would achieve more for the loss of a lot less blood.

        Given that the United Snakes Of America was founded on the ideology of white supremacy and white supremacy remains its prevailing ideology, with its people indoctrinated with it from birth, if there was any kind of uprising or civil war, the end result would mostly likely resemble Nazi Germany.

When the purpose of a change in delivery of disability benefit is based on reducing numbers then the worst will happen and people who are entitled to the benefit will find it difficult or impossible to get. You can’t base these benefits on projected savings, there can be no mechanism that makes that work without causing harm. Another issue with this is that DLA is still operational in many parts of the country and you can’t request to be assessed under the new PIP criteria even if you wanted to be. Many are actually losing out as they might be entitled to a higher rate as the PIP descriptors give more weight to fluctuating conditions and some on low rate DLA would be entitled to standard rate PIP which is £30 per week more. Another fine mess from the department of fun.

    • Any relevant change of circumstances notified by someone currently in receipt of DLA will result in them immediately being forced to claim PIP. It isn’t just new claims that are being buggered up by PIP. There is no chance of requesting to be assessed under PIP for many, it’s a case of being coerced into it, with destitution as a possible alternative to saying “no thank you, I’d like to stay on DLA”

      • A change of circumstances may be a change of address, a change in GP, death of a partner, or other things not associated with the actual medical aspect of a claim. This can also cover getting worse (as the post above says), where those affected have actually stayed on the lower rates of DLA rather than face this scandalous system, and the all too probable stripping of all benefits, rather than an increase.

  11. whats getting overlooked here is everyone’s grandparents and parents have worked and payed into this system , most of them never had a day off in their life the funds should be piled high to pay for the next two generations regardless if they worked a day in their life or not . , so obviously our money is not being invested right , so where is it all going ? why should we take the blame for the errors ? The MPs who are handing all this excrement out to us all have private medical insurance paying them full wages for life , private health care , best treatment in a private room with a silk dressing gown . Imagine their faces if when they turn ill they get a letter saying in the small print they are only to get paid £71 a week then taken to their room and find a pair of overalls and boots on their bed with an Atos Nurse smacking them around the head screaming LIES , LIES , You can work , you can flush the toilet so its a toilet flushing job for YOU !! shoved into a job that they cannot do on health grounds then end up on the sick again , all that aggravation to save with a basic rate, . , then letter after letter ,saying they need more proof of their illness or their bank account will be frozen , constantly worried if the rents going to get paid on time , then sanctioned for being too ill to make it to the medical , then evicted , and lay in the street , too ill to move . All rights removed , legal aid abolished conveniently before the sanctions started so no one can be sued , A perfect situation for the rich to treat the poor how ever they like .They can all smirk about this because it will never happen to them , they dont know what its like to have no money and home in a land that has illegal camping laws , but look on the bright side , once homeless , ill and had your benefits stripped from you , you can enjoy watching them confiscate your tent and expensive life saving camping equipment off you, what a caring society we live in run by savages in suits . everyone is voting to be kicked in the teeth with their hands tied .

  12. There was a time when investigative reporters would have crucified this atrocious government for its cruelty and wickedness in every paper. But now, after years of remorselessly dripping words of hate about any and all benefit claimants, vilifying all such people as “scroungers” and such like, horrors like the one described in this article can go on remorselessly with no one being taken to task.

    Iain Duncan Smith, David Freud and Esther McVey would never, ever, in a million years have ever been able to get away with things like this five or ten years ago. I am ashamed of British journalism and our media for allowing such evil to go on unchallenged. It is a national disgrace.

  13. Plenty of people with a terminal diagnosis are being left without PIP (or DLA) because of the gargantuan backlog of assessments. What a helpful and fun distraction from impending death this despicable toxic crap from the DWP must be to those souls eh?

    Macmillan and Marie Curie have both made mealy mouthed statements/complaints about this state of affairs, but as usual, they say nothing that might damage the level of donations they receive.

              I am really sorry to tell you this, scottish independence will mean VERY little to the working class person in Scotland, Fox and the rest of the leadership of the SSP have sold out the working class!, when they turned on Tommy Sheridan it was LONG before all the troubles that were to come (were known about).

              Those in the SSP KNEW when they turned on Sheridan it would end up destroying the SSP, you have to ask yourself WHY did they do it, it made no sense!, I tell you other things were in play.

              As for the SNP, when it first started up it was a FIRM left of centre party, more left then centre, it had true ideals, as the SNP gained in popularity and votes the carpetbaggers who were looking for nothing more then lucrative opportunities to further their own self-enrichment joined and worked their up the ladder to gain control of the SNP (just like what happened to the Labour party) you need NOTHING more to illustrate this then when the SNP voted to stay a member of NATO, yes they say Trident will go, will it, they are now saying it will take at least three years after independence to get rid of Trident, what does this tell you ?, it tells me all is lost as to things will get better for scottish people if they gain their independence!. Still, what does it matter as to what you and I think, time will tell…..

          I doubt these two are the politicians with similar or same names from the Scottish Socialist Party (SSP).
          Colin Fox is still going strong defending Independence for Scotland, and was on the wireless, Friday in Inverness doing just that. Dunno what ever became of Rosie Kane though.

    • Thats a pity. Don’t wish Kane any harm. But I was as you were disapointed the way they turrned on Sheridan.
      One thng I do know about Rosie Kane is that she has suffered greatly from depression, even when she ws an MSP, the girl had depression.So that is nothing new for her. Obviously ATOS wouldn’t care about any of that.

          Was a witness to hearing a guy withlearning disabilities being sanctioned. I heard the conversation. I saw the guy at the beginning of the week and it was very clear to me that he had learningdifficulties. He clearly did not understand what they meant and they sanctioned him. What kind of support do they have .

  18. Anyone with a learning disabilities should be granted support ESA – no questions asked. Before the Tory scum came into power such a condition would automatically qualify for Incapacity Benefit.

        the best way to help people is to get off theirs backs, take their imposing pressure/weight off, so that people are not stifled/suffocated…then people help themselves..in the mean time pay benefits at a much higher rate than they are now….this will guarantee better outcomes…the trouble it that we have been brainwashed into thinking, that they know what’s best for us, that we are not good enough to know our own massive and beautiful minds…they want to be in charge, the only reason they do as they do, is for POWER over others….

    My partner has just got a decision and thankfully been awarded PIP after a wait of 44 weeks, 10 fucking months. In that time, we have been pushed to the brink. Selling everything just to pay the bills and getting behind on the rent. Just think before IDS brought this totally fucked scheme in, if a DLA claim to over 6 weeks you were very unlucky. IDS is not incompetent as some claim. He was specifically put in his job to fuck as much up as humanly possible and take the flack off of Cameron and Gideon.

    HAVING READ ARTICLE SIX, SECTION ONE OF THE HUMAN RIGHTS ACT, I AM IN NO DOUBT THAT OUR GOVERNMENT, ESPECIALLY THE DWP, BREACH THE MEANING OF THIS LAW, AT EVERY CHANCE……………

    Article 6 reads as follows.
    “ 1.In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interest of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice.

    AFTER COMPLAINING THAT A JUDGE REFUSED TO STEP DOWN FROM MY ESA TRIBUNAL (RECUSAL DUE TO BIAS), I WAS SENT THE FOLLOWING INFORMATION FROM THE HM COURTS AND TRIBUNALS SERVICE;

    ” Many judges will see the same customers over and over again, but that does not disqualify them. It is for the tribunal judge to decide, in the exercise of his power to regulate procedure………………….

    TO PUT THIS IN A NUTSHELL, WHEN APPEARING AT A TRIBUNAL IN SCARBOROUGH FOR ESA, I WAS CONFRONTED BY THE SAME JUDGE AND HIS SIDEKICK DOCTOR WHO HAD REMOVED MY DISABILITY LIVING ALLOWANCE SOME WEEKS EARLIER.

    FROM THE ONSET I DECLARED THAT I WOULD NOT BE JUDGED BY HIM AS THERE WAS A STRONG POSSIBILITY OF BIAS, WHICH THERE WAS.
    CONSEQUENTLY, I WALKED OUT IN DISGUST, AFTER THE JUDGE DECIDED THE CASE WOULD CONTINUE IN MY ABSENCE.
    THE SYSTEM IS NEITHER, INDEPENDENT, FAIR OR IMPARTIAL, THE WHOLE SYSTEM IS CROOKED.

    I HAD PREVIOUSLY HAD MY BENEFITS REMOVED BY THIS JUDGE AND HAD INFORMED HIM THAT I WAS LIVING FROM HAND TO MOUTH EXISTING ON £32.30 PER WEEK SINCE LAST JULY.

    YOU ARE BEING DEALT SUPERMARKET JUSTICE BY THE SAME OLD FACES THAT ARE FILLING THEIR POCKETS ON THE MISERY THEY DISH OUT ON A DAILY BASIS.

  25. I really, really hope that Scotland becomes independent. For the past 30 years I have been studying what could be called the break up of Britain, and it’s hopefully a process that is rapidly seeing the earliest parts of England’s empire seceeding. Scotland becoming independent might even impact on the move towards Welsh indpendence, which is currently at a low ebb with only about 10% of the electorate in favour – but who knows, maybe Scotland finding the confidence to go it alone might have a positive effect on the people of Wales. Maybe Wales, England’s first colony will be the last to leave, but I hope it happens.

    England too badly needs change, and maybe Scottish independence will bring benefits there too, and stiumlate a debate, and more importantly action to create a fairer society there too.
