Half Of Claims For New Disability Benefit Rejected As Massive Backlog Develops

atos-finalEarly figures from the DWP reveal that half of all claims for Personal Independence Payments (PIP) have been rejected. Appalling the figures also show that claimants are waiting up to six months for a decision on their claim whilst a massive backlog is developing.

PIP replaces Disability Living Allowance (DLA) and is currently being rolled out for new claims only in some parts of the UK.  Most DLA claimants will not be re-assessed until Autumn 2015 when the notorious Atos, along with bungling Capita, will begin the work of stripping vital benefits from a fifth  of disabled people.

PIP began in April with 31,900 claims made by July, jumping to 99,600 by August and 171,800 by October.  At the end of the year 229,700 total claims had been made for PIP.  Despite this just 43,800 decisions had been made by December 2013.

These figures include people with terminal conditions who are fast tracked through the process under special rules.  When this group is removed from the figures, just 34,200 decisions had been made by December, despite a caseload of 22o,300 people awaiting a decision by the end of the year.

Most of these claims were rejected.  For those not covered by the ‘Special Rules For Terminally Ill People’ only 37% of PIP claims were successful.

Government ministers have lied through their teeth to justify stripping away this vital benefit from disabled people.  Last year Esther Mcvey made the astonishing claim that 50% of DLA claims were successful on the basis of the application form alone with no corroborating medical evidence.  The true figure was around 10%.

McVey also claimed that “vast majority of claimants get the benefit for life”.  In truth only 23% of people received an ‘indefinite award’ in 2010 (PDF), and 24% in 2009.

The worst impact of PIP is set to come after the next election – and Labour have not said they will halt the re-assessments if they win.  But these early figures give a hint of the vicious shambles to come with almost a quarter of a million disabled people already waiting months on end for a benefit they need – but probably will not get.

        • I hope I am not paranoid here but on BBC regarding floods where they have called in the army ..it said that ppl were concerned about looting of empty properties due to flooding and that they have called in police to set up road blocks and check points .

    Speaking of massive backlogs….I’ve just returned from the Jobcentre where I was kept waiting for one hour to sign-on. FFS. That’s no faster than it was in 1979.

      The last 4 times (2 months in total) I have been approached after signing on, and have been ordered… to sign on! I say ‘I just did’. They say I didn’t, and deny they just signed me. Threatened with sanction for lateness or not signing on. When I was on time and when I had just signed, they ignored crucial evidence like the new job log form, for the next two weeks, which you can only obtain by signing on.

          • I never read it in any mainstream press program or publication. I’m talking about the BBC news ITV and the like plus the BBC web site. No mention of it there or if it is it’s buried away behind the scenes. 38 degrees is not really what i’d call a mainstream publication. When i say that i mean the major TV channels and newspapers. 99% of the mainstream press are run/owned by individuals with a right wing agenda. That’s the real reason it was all kept very quiet.

            • @raining after I came across this report by a security firm that had been snooping on disabled activists I offered it to journist in main stream who dropped it like a brick and didnt want to touch it.
              That must tell you something ..
              And yes I passed it onto the disabled activist
              group who thanked me for it .

              • Yeah that doesn’t surprise me one bit. Mainstream news outlets don’t want to rock the boat and certainly don’t want to educate people as to controversial laws that are gonna be affecting their lives, usually negatively. My original point was that Joe Bloggs probably doesn’t read political blogs and sites like this so tends to only get fed what your standard news outlets feed him. So much happens that he doesn’t hear about. Now i believe that if the gagging order was more widely known about by the general public there’d be much more of a vocal backlash against these corrupt idiots who are trying to stifle any protests. Now we’ve got a situation where charities like the Trussell Trust have been silenced, unless they’re prepared to accept the possible legal ramifications down the line. Truly disgusting piece of legislation and makes the UK seem more like Nazi Germany.

                • TT are also q. corporate in their approach – sending out a representative to explain to local groups people setting up a TT foodbank which logo/s they should use/what type of tabards etc. their staff should wear, at a starting-up meeting. TT foodbanks are franchises(?). The one setting up, in this area had the stated intention of talking to people about their circumstances on arrival – over a hot drink – and ‘signposting/referring’ to outside agencies – eg. drug & alcohol, if thought relevant. (More lay people passing judgement on people who have been referred for basic necessities – people already at a low ebb – to expect them ot take the handout and not feel obligated when the request to give the particular religion a try is made (captive audience) … So not a case of just turning up & being given some emergency rations … not made clear in any publicity materials/information given out in the local community regarding the new ‘Foodbank.

                  Their approach is to include an invitate to church /either meeting/service as part & affecting their lives/ helping them to alter their circumstances. It felt patronis\ing/paternalistic and misguided – and intrusive –
                  & so didn’t pursue voluntary work there. it did seem as if intention of the setting-up group was to help those less well-off/in crisis, but not by meeting basic requirement for food. It definitely didn’t feel like a free lunch or ‘something for nothing’ – more lke crisis intervention (foodwise) … but with strings/implied judgements attached.

Off-topic but I found this slightly amusing – Parliament is currently debating Fairness and Inequality, and Jacob Reese-Mogg (Tory twit par excellence) got up and said (I’m paraphrasing here) “it is unacceptable for those out of work to be better off than those who do work”, then followed this up with “the benefit system traps people in poverty”…

    Now, don’t these statements come across as mutually contradictory? Oh the mental gymnastics the Tories will use to justify their attacks on those dependent on our Social Security system!

  13. I have been reading online disability forums where participants who have had DLA disallowed are awaiting PIP decisions ..they have been waiting months and months now
    And still no decision
    A friend of mine who had her lifetime DLA removed is worried how she will keep her job as the DLA helps her able to drive to work.
    She has brittle bone disease and is in pain and not able to use buses .
    She is worried she may lose her job as result of this ridiculous decision
    Strange how a party that believes in work is risking someone losing their job because of penny pinching policies.

      Would a paralysed IDS like being got up at 7am each morning and dragged into workfare? No power to heat a kettle or pan because they cut it off, because his benefits got stopped? Would he like to look after screaming starving kids at the same time, who just about go to school (keeping him out of jail as an ‘aider of truancy’), who keep falling asleep or passing out in school and the kids and teachers say they’re unwashed and smelly? “Um there’s no water miss, they cut that off too.” Kids who can’t do homework because the computer was pawned or reposessed or the library was demolished, or they have textbooks they can’t read as the lights don’t work. Household budgeting that is not a choice between food or heating, but a choice (as unable to afford either) between paying rent and getting in trouble with bills, and paying bills and getting in arrears with rent.

  15. I honestly think that things are collapsing around this un-elected coalition and that the amount of pressure they are under is getting to them. There are complaints and arguments from so many members of the public that they are beginning to see that they won’t be in power for much longer.
    All I can say is, the floods, which have affected so very many people, have shown just how bad this government are when their backs are against the wall. In the US this would have been called a disaster and things would have moved faster and people would have been thought of – not had to wait six weeks before money and the army were brought in – it’s also showed the people that the threat to the Thames and along it are more important than anyone or anything else as they have practically promised the earth to those affected along there.screwed this government up and made people see just how bad that they are!
    The floods have also shown that this government is inept at doing anything – the collapse is coming, and it’s coming soon!

        Surprised “Labour” haven’t yet been pointing that out.
        Most places hit by these floods all have tory MPs. Some are the blue Cameron division, some are the orangy-yellow, Clegg poodle division. They all were of the opinion that public services were too costly and not needed. Thus we see Counties in England closing down fire stations, and letting go police officers, etc.
        Now these flooded ppls want to know why they don’t see police, etc, or wait for a fire engine, and why the local councils ain’t doin enough, “Where are all the council workers”, etc, etc.
        As it happen now, it’s gonna cost billions more to redress something that might have at least been mitigated to some extent if all that money had not been cut to begin wid.

        Meanwhile, they keep telling us the poor, the sick, unemployed, and disabled, etc, are costing us way too much money. They can’t afford to pay them a dime. And besides, all those ill ppls an disabled ppls aren’t really.
        So what does Regime do??? Spend billions an billions a year extra of welfare money on ATOS, A4E, etc,so the bosses can pay themselves £22,000 a day and then blame it all on the ppl who have nothing!
        As Cameron has said, money is not a problem…so long as it is not going to the ppl, but to his pals.
        And Labour…sorry…the party that used to be “Labour” do nothing. Actually the promise a lot more of the same.
        The floods may be from nature, as they say, but the disaster it has become is made by the Regime at Westminster.
        My only concern regards these floods is also that voiced by bobchewie ! And I wonder if Cameron’s money promise extends to them

              Does that mean “positive ” ” negative ”
              Ie are they awarded the £20 extra if the report is rejection of PIP claim ?

                Eg I was wondering how the PIP assessment
                process worked ..hence me looking it up on Crapita site…and noting apart from the £32k assessors were paid they got £60 per report
                which is £40 plus £20 depending on the grade or ‘ quality ‘ of the report thus making
                wonder if this £20 extra was if the report resulted in a denial of Benefit ..thus an incentive was being used

    • Are you kidding? I’m in the US and they’re just letting people die here, at best you can expect homeless and no medical treatments while you wait unless you’re some (very few) who were secure enough to not need the pension in the first place. I checked the stats and the disability program approval percentage hasn’t moved in the last decade even though the increase in apps is almost triple. You don’t want to know what they do to our vets but a thirty percent of our homeless are vets most of who can’t even get decent medical treatment..   16. i have been to the jobcentre today,my advisor couldn’t even work the computer properly.then he had the cheek to talk to me as if i was something he just stood in.the jobcentre staff are getting worse.they are just plain nasty

      • If there are delays and rebellion at Crapita over PIP then why oh fucking why were they given the contract when its evident that they are NOT up to the job…we have seen all this before as result of outsourcing to privateers ..but again and again they keep getting contracts ..bloody hell Lord Fraud speeches are called ” Capita speeches ” does that tell you just how cozy this fucking lot are to business …its stinks of corruption

          Just thinking out loud a little really about the fact that I had a PIP assessment at home on 04/11/2013 (Capita) by a lady I called Doctor several times as I naturally assumed a person making an assessment on my physical health should be a doctor preferably specialised in my particular problems. After a while I was corrected by the lady who stated she was a nurse, I never gave this a second thought and failed to ask what type of nursing she was qualified in.

          I recently had cause to speak by chance to a lady who is involved in tribunal process for pip and other things and got to talking about the nurse in question. The lady advised me that the assessor could be a dental nurse or other type of nurse with no experience in assessing physical or mental issues etc…..

          It’s just a thought but I think we should be getting some kind of idea of who is assessing us and their title along with their formal qualifications to give us some kind of idea of their ability to assess us. Just think an assessment could be conducted by someone from a dental practice who I’d say is hardly qualified to come into our homes to conduct such an important assessment which if failed will have a huge impact on our well being. (By the way I’m not putting down anyone who works in the dental profession as my wife is employed in a dental lab but is hardly qualified to conduct such assessments.)

          When I think I had an assessment at my home address (no result yet, still waiting to hear) by a person who I knew nothing about.

          It’s just a thought that in a future tribunal it could well be the fact that as part of the appeal process the fact that the assessor is not qualified in the correct medical field for example to conduct the assessment could be bought up. We will only have an idea of their ability/qualifications if we ask.

          I hope this makes sense, another example might be say a mental health nurse assessing me with physical disabilities. How is the mental health nurse qualified to assess me?”

It is the same approach upon which the current Atos work capability assessment (WCA) is based. Concomitantly, the company were advising the UK government on welfare reform.

Well everyone is so angry with the constant contradictory messages and double binds these authoritarians spew out. These are designed to drive a person insane, and to cover their own dirty tracks of course. All they care about is power, money and adulation. Basically disability benefit for many is abolished!!!! Why don’t they just admit the truth and say ‘we abolished the welfare state’. How will they justify this? perhaps people don’t need it any more because they survive so well on minimal wage, and a miracle happened , all the sick and disabled in the land all got better, and dumped their mobility scooters.

        Do they think the poor will get rich on the minimal wage, and get on the property ladder with it? Surely not? They think they will say ‘ England is great again, all because of us the Tory party, clearing up the mess what labour left behind’. What kind of fucking mess are they going to leave behind in 2015?

          • Theres a storm brewing from october 2015 when the lifetime/indefinite awards have to start to claim PIP as well as the £21 lower rate DLA there’s the disability premium that’s even more £31 a week for a single person on jobseekers allowance for example.there’s also a loss of council tax relief too

            This doesn’t mean the person isn’t any less disabled,also DlA remains for those under 16 and over 65,slashing benefits is all to do with spending cuts under making work pay.this group is a substantial disadvantage compared to others in finding work,jobcentres dont like people declaring a non immediate visible disability to employers’ at application stage’s but to be covered by the equality act they have to.if they don’t and problems related to their disability surface they will simply be dismissed and not covered.that’s if they find work at all and get to the interview stage.

            The reason these benefits are lifetime/indefinite is because people with for example learning difficulties are affected throughout their lifetimes,many will have little education and been traumatised with resulting mental health problems’.

            Today someone with this condition is likely to find themselves at the brunt of post work programme “support” in the jobcentre simply aimed at just getting rid of them.

              When PIP was first designed it was deliberately designed to exclude lower levels of support that came with the DLA system. There would be no Low Rate Care or Low Rate Mobility payable with PIP. This would automatically result in one third of DLA awards being removed under PIP.

              Osbourne and IDS both announced that PIP would reduce the amount payable under DLA by one third. The announcement was made in the context of reassessing disabled people to deal with fraud. It was a nonsense. The only determinant of what PIP would be was how the beads on the abacus settled.

              For people with MH problems, the lower rates of DLA have so frequently, been a lifesaver and they can be the difference between making it, and not making it. For instance if, someone cannot use public transport due to severe anxiety, the LRM DLA component might allow them to run a modest car or take a taxi or pay for petrol to someone giving them a lift. The payments enable them to get to health care appointments, job interviews and yes, even to work. Take the payments away and you take away the ability of that person to attend those events completely.

              Mental Health is right at the bottom of the barrel as a priority in this country. Those disabled in this way are the easiest fish to shoot. People with MH problems are the least likely to receive a fair PIP assessment or even an award.

Had PIP assessment on 9th January 2014 and received the decision(albeit wrong from my point of view on 7th February(letter dated 31st Jan). Apparently I only got 4 points for each section,yet I received 9 points for mobility side of ESA? I am waiting for the prat in the office(decision maker) to ring me and tell me why I failed. I know why and it`s got nothing to do with my health directly! I just happen to be one of the many thousands who “fail” to keep Idiot Duncan Smith and the DWP happy!

              yes…don’t let them rob one of one’s symptoms, because that is what they try to do…symptoms furnish descriptors not diagnosis….often there is no full diag at wca/pip et al…so how they can even come up with a prognosis is miraculous imo….diagnosis is caused by symptoms, diagnosis does not cause symptoms…it is a constant relentless grind with victories along they way….look at this on MR…..

  30. It will be interesting to see who the people vote for next year in the electiion but with the labour front bench openly accepting benefit cuts it won’t do us any good whoever wins. By then everything the tories want will be in motion, a good number of the unemployed doing unpaid work which labour won’t reverse and more benefit cuts that labour are signing up to. Whatever problems the tories have they just change the law to suit themselves and as they have the control over the purse strings they can just keep us all waiting for years to reverse anything the courts say they must.
    The only solution for us must be the unions showing some strength and supporting the poor but these days unions don’t want to strike for anyone but themselves and solidarity might be a word erased from the union bosses vocabulary when it comes to supporting the needy.
    I would like to see a few comments on here that gave me hope that after the next election or before we might see the end of any kind of workfare or benefit cuts but I’m not holding my breath.

  33. on the 18th of this month, next tuesday, i am at a tribunal to try and have my DLA reinstated.
    They took it from me last july after i failed to fill in a form about how my disability affects me, in order to know if they are paying the right amount of benefit……………….
    Rather strange really, because it effects me like it has done for the last fourteen years, since an accident at work………..

    The questionnaire which they sent me, sought two signatures. One to say i gave my permission to access my GP’s records they hold on me, and also to make it available to a hcp they might use.
    The other signature was the one to state that i had told the truth and action could be taken against me if i had been telling porkies.
    The questionnaire is the tick box bullshit type, where whatever you wrote would be construed as a change of circumstance to accelerate you to an early PIP test .
    I wrote and told them my circumstances had not changed. They decided that if i did not fill in the questionnaire, they would terminate my DLA.
    They did.
    Even stranger still, they sent me a letter explaining my disability and how it effects me, but went on to say my disability is not in doubt, they have stopped my money for not completing the questionnaire.

    The questionnaire is not marked by anyone of medical knowledge, just a DWP decision maker.

    Several MP’s have criticised these tick box questionnaires, stating they are not fit for purpose. I agree.
    One of the questions was, how many days a week do you have difficulty walking?
    Another, how many times a night does another person need to be awake to watch over you?
    How long on average, does another person need to be awake to watch over you at night?
    Is there anything else you want to tell us about why you need someone to watch over you at night?
    How many nights a week do you need someone to watch over you?

    I have never seen so much crap in my life!!!

      Two thirds turned down for new disability benefit

      Two thirds of applicants for new disability benefit the Personal Independence Payment (PIP) have been turned down, the first official government statistics reveal.

      While over 99% of claims made for people with terminal illnesses were successful, figures reveal only 37% of standard PIP claims were granted a cash contribution towards the extra costs associated with a long-term health condition or disability.

      The Department for Work and Pensions (DWP) has received on average 30,000 claims per month for PIP, which was introduced for new claims in April.

      Now being rolled out for existing claims of Disability Living Allowance (DLA), PIP includes a face-to-face assessment and regular reviews.

      Evaluations assess a claimant’s ability to carry out a range of everyday activities alongside reading and verbal communication.

      According to the DWP, only 6% of new DLA claimants had a face-to-face assessment with a healthcare professional – meaning over half of all decisions under the previous system were made without additional corroborating evidence.

      Minister of state for disabled people, Mike Penning, said: ‘Personal Independence Payment has been designed to better reflect today’s understanding of disability – particularly to update our thinking on mental health and fluctuating conditions.

      ‘We are world-leaders in support for disabled people with the UK’s spending on disability-related benefits a fifth higher than the EU average. Our reforms – as part of our long-term economic plan – will ensure this support is better targeted at those who need it most.

      • This is dreadful. I remember them announcing the support levels for PIP and the descriptors automatically removed the lower rates of support for mobility and care that worked so well under DLA. This would have resulted in about one third of total applications/renewals being denied.

        That two thirds have been denied is beyond shocking. I think someone somewhere in DWP/PIP/Provider liaison must be working overtime on the predictive stats and re-norm-referencing the scores so that some departmental wanker can announce….

      The training of social workers in England needs upgrading, with more emphasis put on practical skills, a government adviser has said.

      Sir Martin Narey also suggests some of the students recruited are not up to the job and that course standards vary.

      He is calling for tighter minimum entry standards and the standardisation of what is taught.

      The British Association of Social Workers says there is scope to improve the quality of training.

  40. Tenant evictions reach their highest level ever recorded

    The number of tenants in England and Wales forcibly evicted from their homes last year after court action reached a record high.

    Some 37,739 private and public sector tenants had their homes repossessed by court bailiffs in 2013, according to figures from the Ministry of Justice.

    That is the highest number since records began in the year 2000.

    However, the number of homes being repossessed by mortgage lenders at the end of 2013 was the lowest in a decade.

    In cases that involved court action, 12,147 people had to hand back the keys to their home between October and December last year.

    The Ministry of Justice put that down to low interest rates and a “proactive approach from lenders in managing consumers in financial difficulty”.

    ‘Ten minutes to leave’

    Andrew, a 53 year-old from Dover, was one of the record number of tenants evicted in 2013.

    He was forced to leave his home in November after a mild illness caused his work to dry up.

    He and his wife had built up rent arrears of more than £3,000.

    When the bailiff came, they expected to be given a reasonable amount of time to pack up their belongings.

    “He said, ‘Well guys, you’ve got 10 minutes.’ That was just shocking, absolutely shocking,” said Andrew.

    Those belongings they could not pack were then left on the driveway in the rain.

    They and their two young children subsequently spent several weeks sleeping in their car.

    “There’d be the two boys in the back, under a couple of quilts. My wife would be up front here. And we’d eat in here,” he told the BBC.

    “The following morning, we’d go to McDonald’s, so the boys could brush their teeth and then go off to school.”

    Three months after the eviction, they have managed to get a single hotel room, but only have enough money for two more nights.

    They cook pasta in an electric kettle and warm up tinned food with hot water in the washbasin.

    “I’ve eaten more pot noodle than I care to admit. It’s grim,” said Andrew.

    ‘Changing circumstances’

    Quite why more people are being evicted is hard to determine.

    It could simply be that more people are renting, or it could be that more landlords are turning to the courts for help with evictions.

    The cost of renting has increased, but only marginally.

    Figures from the Office for National Statistics (ONS) show that private sector rents across the UK rose by 1% last year, well below the rate of inflation.

    But in places like London, rent rises may have outpaced wage increases.

    “Rents have been rising at a faster rate than wages, and tenants are frequently maintaining their lifestyle on the basis of credit,” said Stuart Law of the property group Assetz.

    He said that many tenants had been lulled into a false sense of security by talk of an economic recovery.

    “But when that credit dries up, and the unsustainable lifestyle continues, payment of rent suffers,” he told the BBC.

    Others were surprised by the figures.

    The UK’s largest lettings agency, LSL, reported last month that rent arrears were falling.

    Ian Potter, the managing director of the Association of Residential Letting Agents (ARLA), said he too was surprised.

    “I can only speculate that it’s tenants who’ve suffered changing circumstances,” he said.

    The picture for those who own their own home is more positive, according to separate figures also published on Thursday, with low interest rates keeping mortgage costs down.

    Banks and building societies reported that 28,900 homeowners had their property repossessed in 2013, the Council of Mortgage Lenders (CML) said.

    This was 5,000 lower than in 2012 and the lowest annual figure since 2007.

    Advice

    The housing charity Shelter says that if people want to stay in their homes when faced with eviction, they need to act quickly.

    “Behind these figures is the reality that just one thing, like an illness or redundancy, can be all it takes to tip anyone into a downward spiral that puts their home at risk,” said Campbell Robb, chief executive of Shelter.

    The charity advises that rent payments should be the top priority.

    Other debts, like credit cards or phone bills, should be negotiated later.

    And those looking for an easy way out of trouble should not be tempted by payday loans.

    Above all, it advises them to get professional advice, or call Shelter’s free helpline on 0808 800 4444.

    Meanwhile, Andrew and his family are still homeless. He has even considered begging on the streets, but is determined not to do so.

    “We will find a home. It may not be where we want it to be, but we will find it,” he said.

    “We will make it our own, and we will look back on this as an experience.”

  41. I’m waiting on decision on whether I can actually appeal. As the letter denying me my increased benefit got caught up in the Xmas Mail, therefore I was late in appealing.
    I’m just finding that I’ve walked into a truly Kafkaesque situation, where I’m assumed to be guilty of trying to game the system. I’ve worked since I was 14, and paid my “National Insurance” for more than 35 yrs. Apparently I’m not entitled to claim a benefit that both myself ang my employers have paid into for all that time.
    GRRRRRRR! I’m so angry and depressed by this!!!!

    • What makes you think that letter got caught up in the Xmas mail, and was not deliberately delayed? My Xmas cards (incoming and outgoing) also got ‘caught up’ in the Xmas mail — but they all arrived on time… What happens happens that way because those in power to make it happen make it happen that way. Everything is deliberate.
